Military income and employment evidence

Hi military folks,

 

We have just submitted I-864 form along with the supporting documentation, but we just received Case FE Review Note(s).:

1. The Petitioner does not meet income requirements - his last year, 2019, tax transcription includes only part of his income because more than half of it wasn't taxable - this is payment for when he was deployed. We've attached form W-2 for 2019 which shows the nontaxable amount on his income. 

The note says that decision would be made by consular office whilst the interview.

 

2. They've requested employment evidence - we have submitted his orders. What else can be evidence of the employment?

 

Anyone has had similar situation?

Also, even thought we had these two review notes, on the home page is says all the documents has been accepted. And there is no way to submit more documents. How do we suppose to do it?

 

Any advise would be great.

His LES to show his current income. Bring them to the interview, maybe last six months. Also get a letter from his command for the employment evidence.

 

That's probably because you're good to go. NVC checked everything just to make sure it's there and now the consular office will make a decision at the interview. It's up to them to decide if they're ok with your financial situation. NVC just gave you a heads up that it might be a problem.

thanks a lot, that helps! I will ask him to prepare LES and get the letter. 

 

Does the accepted status means Document Qualified?

Unsure of this - on your CEAC account, NVC sent us a message specifically saying 'Documentarily qualified' and we also got a separate email with 'notification of application becoming documentarily qualified' 

Something you may want to chase NVC about? Would hate to think your application is delayed because of some small clerical issue.

Timeline

When I did my k1 fiance visa and had to submit that form along with evidence documents for that affidavit of support form. 

 

1. US Navy contract (so they can see he is active duty and until when he will be employed under them).

2. History of Assignments (so they can see proof he's been employed with the navy since 2012)

3. Monthly LES for the entire year that year which was 2018 (I had my interview  in August so I had till August)

4. IRS W2 Forms for 2015, 2016 and 2017. 

5. IRS 1040 Forms for 2015, 2016 and 2017.

6. IRS Tax Transcripts for 2015, 2016 and 2017.

 

Those are all i submitted and i had no problems. My embassy back then did not have online services yet. So i just brought all that to my interview. I had no problems.

Prior the note from NVC we submitted:

- irs transcript 2019 (that’s the one with like 1/3 of his actual income because the rest was non taxable)

- w-2 to support the above as it shows non taxable income

- irs transcript 2018

- original contract and first assignment 

- command sponsorship paperwork

- form i864 ( which mentions his 2019 income as it is in his tax transcript for 2019).

 

it actually makes me wonder if the only thing NVC checked was the i864 form...
 

after the note from NVC and employment evidence we have submitted the following today:

- active duty employment verification 

- employment letter from this shop command

- LES for 2020 so far

- his current Deros and its extension 

 

hopefully we will be good to go now!

I know this post is kind of old, but the best form of proof of currently military service is called a "statement of service".  Your admin office will from one up once you provide all the info and your CO will bottom line it.

Yes you are right. That's a great form. Though its usually for when a military active duty is applying for USCIS benefits for himself/herself. Like n400/citizenship for them. But i felt like for applying for a military spouse, like for my own n400 citizenship it makes less trouble for the command and my military spouse member to do that form. So i went and did my military husband's navy contract. (I used it too so they know when he was active duty and till when he'll be active duty. It has the info and i didn't bother anyone.) But i also had the dd1278. Just a thought if ever and at least an alternative.

The contract is another great form to use as an alternative.  I wish I knew where mine was, haha.
