Hello

 

I urgently need information on AOS case of my son, who was in USA last year in August and applied for AOS (I-485, I-131),.

His finger printing/Biomatrices was also completed in October, however due to family emergency he left USA in December 2019 without receiving his Advance Parole documents and EAD card.

Later in April 2020 we received his advance parole/EAD card in and as per current I-485 USCIS status is "Pending For Final Interview" which can be scheduled any time now.

My question is-

Can he use Advance Parole Document / EAD card to reenter USA if I send all these documents to him through overnight and attend final interview with USCIS for green card.

No reason to return,  once they see the travel history,  the i485 will be denied.

No, he now needs another Legal way to immigrate to the country. This is a huge draw back to adjustment of status that people don’t take into consideration.

Packet 3 Sent : 11/10/13.. Had to schedule interview appointment and attach confirmation receipt to packet

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15

There's a portion of  I-131 that caters for those outside the country. Why is it there then? Or why can't OP's son utilize that choice?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

No... unfortunately he abandoned his AOS case the moment the plain left the runway. 
 

‘you’ll need to make application via consular processing now.

A person with pending I-485 must have approved Advance Parole prior to exiting the US.  He abandoned his adjustment of status.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Nothing to apply for in this case, abandoned when left without AP.

I would get the application is as soon as possible, he is in danger of ageing out.

There's a difference between the Advance Parole and the re-entry permit. Both use the same form (i-131) but the AP is for those who aren't greencard holders yet, while the reentry is for greencard holders who are going to stay outside the US for a year or longer. The latter doesn't require you to stay in the US until approved if I'm not mistaken (only until the biometrics are taken), but the AP does.
