OCTOBER 2020 K-1 NOA2 to NVC to EMBASSY

Hi all,

 

NOA1: March 11

NOA2: October 29

 

We were thrilled to get the NOA2 recently but we're in a slightly unique position because my fiancée is from Iran. As you may know, Trump's "Muslim Ban" has caused people to get rejected at the interview stage in the past. I feel like we'll be in the clear if my fiancée can only manage to get her interview scheduled after inauguration day (1/20). According to the NOA2, the approval notice is valid through 2/27/21. I would greatly appreciate any advice on how to best navigate this timetable.

The election is not over till the fat lady sings. (https://en.wikipedia.org/wiki/It_ain't_over_till_the_fat_lady_sings). President Trump is still the President till all the votes have been counted and there are no issues. The President-elect will get a vote from the electoral college at which time we will know who the new President elect is. Just keeping it real. 

 

So, to answer your question. You'll need to interview and see where "the chips fall". I know this is a difficult time but you have to trust the process. Do the best you can that's all anyone can ask of you. Good luck and stay engaged.

I guess to update my question, let's pretend that Trump is out and the immigration policy has been adjusted by approximately Jan 20. Is there any approach you'd recommend we take to help ensure that the interview is ultimately scheduled later rather than sooner?

our Noa2 is good until 2/25  but its hard to believe an interview can happen so quickly when march cancelations were not rescheduled in Bangkok until Dec 23.

 

Noa2 On 10/9  of course I didnt get the email I signed up for.. that I know of. But in the mail on 10/16.. Just called and no wait and got the case and invoice numbers. just about   32 days

The approach will not change. USCIS will continue to adjudicate cases like that have been for oh so many years. A President can make changes to the overall immigration, that's written into the US constitution. A new President can't just come in and say oh I want everyone who is over one hundred days waiting should get approved now. It doesn't happen that way. You will still need to follow the system unless something changes in the system. For the most part immigration policy is based on your background and your country's background. To change that would need congressional approval and not a new President.

Please complete your timeline so others can benefit from your dates. VJ timelines help others gauge when they may receive something based on history.

 

A fiancé visa must be issued within four months from the date of approval of the fiancé petition by USCIS (U.S. Citizenship and Immigration Services). If your appointment is later then the validity date, bring a signed and dated letter from your U.S. fiancé(e) stating that you both remain legally free to marry and that you intend to get married within 90 days of your arrival. E-mail or copies are acceptable.


9 FAM 41.81 N6.2 Validity of a K-1 Petition
(CT:VISA-2165; 08-21-2014)


An approved K-1 visa petition is valid for a period of four months from the date of USCIS action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States. 

 

So, your NOA2 is good for one year.

Got it. One last question (for now, ha)...when the time comes, how will the consulate know the email in which to contact the beneficiary with the checklist of necessary documents? Don't believe there's a portion of the I-129F that asked for the beneficiary's email. EDIT (I assume the letter from the Consulate in Armenia will need to be sent via email, since physical packages cannot be sent to Iran).

I created a PDF paper, first page, first post of this thread, that outlines just about every question that has been asked by many before you. Get a copy where you’ll find your answer with directions on how to complete. Sure I could answer your question but I’ll leave the heavy lifting to you. 
 

BTW, I recommend that when you join a thread read from the beginning to see of your question has been asked before. You’ll be that much farther ahead. Just saying.

Timeline

I need to ask some I-134  and  NVC questions.

When do I send in my I-134?  I thought I sent to the beneficiary to take to her interview? But it seems like maybe this is  filed so NVC can look at it before they send the case to the Bangkok consulate.

What is my USCIS Online Account Number?  is it the WAC #?

I see the tine at NVC was 70ish days in the past but now is closer to 200 days?  I guess we are all thinking this number should go back closer to 100 soon?

What do they do at eh NVC center with our case?

Sorry if I should have read these things but I was in lala land this past 8 months. So if I read and understood things back then I am confused now... I got excited with NOA2 but a month later anxiety has set in.

Hey guys. So I did play around with the DHL "hack" and basically I went through all the dates from aug 1st till today , and I see a lot of other shipments sent out on dates different than the dates listed in the PDF @Greenbaum has so kindly put together!

Also, the USCIS site says they approved our petition on oct 28th , however the physical NOA2 copy lists 10/26 as the date of the notice. Which one is correct?

Also , I did locate a package sent out to Bulgaria on Nov 10th , gonna call NVC tomorrow , hopefully its ours! I doubt they'd have sent it out so quickly but who knows ...
