already married, when and where to apply? London or New York

Hi Everyone,

I’m new to Visa Journey and would like to describe my situation and ask a couple of questions. I am a Czech woman who just married an American who I’ve been dating for 5 years. We’re both students in London, but my husband’s course will take him to New York next year, while I have to finish my final year in London. At present I have a ten year multiple entry tourist visa, but I want to join him in New York once my school year finishes so I’ll need to get a resident visa. On those facts I have a few questions:

1) When should I start applying? My main concern is: once my visa is granted, will I have to enter the country within a certain window of time? If so, I need to try and line it up with the end of the academic year.

2) If I have an application for resident permit open, can I still travel to America? I will definitely want to spend Christmas with my husband, and hopefully some other days. So can I still come in on my multiple entry tourist visa until the resident permit is granted?

3) How long do these applications usually take? And if I apply in London and nothing has happened at the end of the school year, can I travel into the country on my tourist visa and then do the interview from New York?

4) Related to #3. We’ll be in New York this summer so should we just apply there in the first place? Should we apply where my husband is living or where I am living? What difference does this make in terms of interviews, documents, etc? Can we change the city of interview if we move? I guess what I’m asking is: do we get to set up a time/date/location for the interview that is convenient to us, or are we just ordered to be in a particular place at a particular time?

I agree that reading guides will be helpful. Your multiple visa is good for you to come to USA. Your husband can petition for you in USA for immigrant visa (and K-3 nonimmigrant, if you want) or he can do DCF (Direct Consular Filing), if he is eligible in London. He can check with it in US Embassy in London. Good luck!
