Public benefits?

Hello everyone,

With all the helpful advice I have gotten here before I come with another question. This whole benefits charge is it in affect? If so does past government use go against you? Or current even if it’s not for you example Disabled child gets ssi with that gets Medicaid. However , we do not have wic, snap and so forth.

we plan to use a sponsor who makes 6 figures and is well established. If that makes a difference we also plan to have medical travel insurance for a year. As I will get a job after college 6 months from now.

Temporary health insurance. In other words that you can get before you leave one country for another.

also considering short term medical plan thru blue cross blue shield 

 

still in the phase of research but I rather prove that my fiancé will have insurance the moment they step foot onto the U.S soil

SSI is disability and person gets medicare not medicaid / medicare is not public assistance/ my son has SSI and medicare

a person is eligible for medicare 6 months from approval of SSI

The public charge rule was always there. As an immigrant you had someone sponsor you and sign a contract with the US government stating you would not become a public charge. It was always enforceable ..now they are just making it clear that it is enforceable and it’s freaking people out...but it’s always been there.

The new form I944 does break down services you may have utilized as well as positives such as assets and education.

 

I’m a bit confused where you are in the process since you posted in k1 yet have utilized Medicaid. Having Medicaid is of course a negative since as an immigrant you weren’t allowed to utilize it. It’s possible you will have to pay back what you used. Travel insurance doesn’t usually cover an immigrant since the purpose of travel insurance is for travelers...

Maybe I worded my post wrong sorry for the confusion.

 

is it true at the consulate/ interview stage they can deny you based on risk of being a public charge? As that’s something we been panicking about due to USC past government benefit use age or is this after say during AOS
 

the immigrant will not never has used any part of government benefits.

 

Medical insurance wise what is recommended? As I’ve seen those and International major medical plan 

 

hopefully that makes better sense

Thank you for clarifying :) You can be denied if you don't have a valid sponsor (your consulate most likely required the I-134). It was always this way though. If your finance doesn't make the requirement you can always have a joint sponsor. At the AOS part (once you are in the US) your sponsor would complete the I864 and you would complete the I944- yes it is possible to be denied at this point.... HOWEVER- if the US citizen used past public benefits that is okay- they are allowed to- they are looking to make sure you as the immigrant does not. As for medical insurance- the cheapest/easiest/best is often through the spouse- so you get married and get on your spouses plan. If spouse doesn't have a plan then your next step would be to purchase health insurance through healthcare.gov- immigrating and marriage are both life qualifying events in which you can enroll outside the open enrollment period. I believe you have 30 days to enroll after marriage or immigration- but you can find this on the site. JUST make sure you don't enroll yourself accidentally in a Medicaid plan. https://www.healthcare.gov/apply-and-enroll/get-ready-to-apply/
