Rejected I-765 (used the old form)... Some questions inside, pls help.

So in case anyone was wondering, the US Govt does not f*** around when it comes to deadlines. They have absolutely no wiggle room when they set a date. "On or after the 25th" means get your stuff in by the 24th.

 

I sent my 130+485(incl. 131/765) on the 24th and it arrived there on the 26th via FedEx.

 

Yesterday I got letter from USCIS saying the 765 two reasons for rejection:

 

1. payment was incorrect or has not been provided

2. application was filed on an outdated version of this form

 

I think reason number 2 shoulda come first but all the same, my application was no good.

 

Question: They tell me to fill out the proper form and send it in with the rejection notice attached to the top. If i do so, will this still be considered concurrent filing? If so, will I need to pay the fee (working under the assumption that it will get it out today before the deadline)? Or since its technically coming later, it will be considered a separate filing and require fee payment (whether before or after Oct 2nd)?

 

 

FYI, I got texts for three other applications (the receipt numbers on those texts are different from the one in the rejection letter) so i'm assuming those are for 130, 485, and 131. This should answer any questions anyone has about whether they reject entire applications if one has a mistake, or whether they just reject the part that's wrong.

 

Not gonna lie, this was a little disappointing, but it's self-inflicted damage. Had i double, triple, quadruple checked everything, i would have caught this. Now i'm likely to cough up more cash than i can afford right now. And having wifey start working asap was a priority as things are getting tougher by the day. BUT, the 765 was never top priority... that was definitely just getting 485 to go through! I hope that whole part works out without setbacks.

09/21/2021 - Email saying “card produced and mailed”

09/24/2021 - Approval email sent for I-485

10/01/2021 - I-765 rejected because “benefits were obtained via other means”

Rejection notice from the I-765 is always due either by those 2: incorrect filing fees or Outdated forms. But most of the time, when you filed concurrently with others forms, it means the problem is the form itself. What I suggest you to do is to look at the current version of the form which is at the bottom left of the form and then write a note to let them know that you are filing concurrently and when filing in such way, the I-765 and I-131 is free of charge. You have to send it back before the 2nd like that you will still be out of the new law regarding the fees increasement

FYI the fee changes Oct 2 have been put on hold currently. I would suggest not rushing and reviewing the application 3 times before you resubmit it. Always triple check when you are submitting any type of paperwork (for immigration purposes or life in general)

Yeah... i'm just gonna send in the Oct 2nd version and pay the fee. I got tripped up when i saw there's a 8/25 version and a 10/2 version. #######. Is the 8/25 version only valid between 8/25-10/2? I'm just gonna send in what I know will work... the 10/2 version.

Not true. If your I-485 is accepted and payed before Oct 2nd, you still go by the old rules so it is free. It states this in the description.

 

So, it will still be free for you regardless, maybe make a note of this and clarify this for them as well.

As posted yesterday and mentioned above the increase in fees has been blocked (for the present)

and as also mentioned this does not help any of the applications now in progress as the new fee increase was to keep Immigration afloat and not furlough employees

i would expect a new furlough announcement from USCIS and things to go slower afterwards/not is favor of anyone going thru the process

It's not concurrently because you're filing after. But your EAD will always be free because your have a AOS filed before Oct 2nd. It doesn't matter if you file after that. The fee change would only affect people who file for AOS after that.

Why would you send the 10/2 version before that if they explicitly say it's gonna be rejected if postmarked before that. You can either send the 08/25 now via USPS. Or wait for Oct 2nd to send the new version.

If you want to keep a deadline and are so close on the date then the only way to go is USPS. They're the only ones that visibly stamp your packet with the date you handed it to them and therefore it will get accepted by USCIS. Doesnt work that way with UPS/ FedEx

Yup.  Funny that.  Same goes for things like April 15 tax filing deadline......
