I've filed taxes with the IRS every year since moving to Ireland. Knowing that I'll need them for the visa interview when showing the I-864, I rang the IRS and asked for transcripts from the last 3 years. I got these by mail within a week.

I read somewhere on VJ that even though I filed, submitting tax transcipts with the I-864 aren't good enough because everything I made was foreign income. Does anyone know if this is true?

Will I actually need to request copies of the actual Form1040 I submitted or will tax transcripts suffice?

Has anyone had any DCF experience where all they showed was the transcripts and were okay?

Our interview will be held at the US Embassy in Dublin.

Thanks for any input.

You don't need the actual 1040s--the transcripts are good.

Your foreign income will not count toward satisfying the support requirement unless it will continue after you move back to the U.S.

Yep, the transcripts are fine. As the other commenter said, you cannot use your foreign income unless it will continue after you return to the US. If it won't, your spouse will need a co-sponsor in the US.

EDIT - By "good enough" are you asking if your income is good enough to be the only sponsor? My guess is that it won't continue when you return to the US, so no it's not enough.

Just adding to the mix - it does not matter how much money the USC citizen has made abroad - if it is foreign income, it does not count at all for immigration purposes. Now, if you have assets that can be liquid in one year, these do count (i.e. real estate, investments, savings, etc.).

In any case, the best way to be prepared for anything is to get a co-sponsor. Better safe than sorry.

Hope this helps, L.

It can count if employment with the same company will continue. Many companies maintain offices and workers in multiple countries. If the OP was transferring his current position to a U.S. location and his income will continue after moving to the U.S., then it can be used to satisfy the support requirements. Further, if the beneficiary is transferring to a U.S. location with the same employer, their income can be used as well to satisfy the support requirements.

Thanks for all your replies.

Sorry for the confusion, but reading Kins' review of her CR1-IR1 experience in London really worried me. This is part of her review:

*******************************

"...Anyway I gave her:

DS-230 part 2

my birth certificate and a copy

one photo

police certificate thingy and copy

I-864

copy of husband's latest tax return - they didn't want transcripts and they didn't want W-2s as he'd only worked in the UK

information on using our house as an asset - I had...

letter from estate agent confirming offer, and copy

statement from mortgage company showing outstanding balance, and copy

entry on land registry to prove it's really our house (just in case), and copy

I'd taken along loads of extra stuff just in case, but none of it was needed... blank I-864, children's birth certificates, husband's birth certifiicate, husband's job offer letter, old tax returns."

**************************

That's what I meant if transcripts are good enough to submit along with the I-864 because the impression I got from her is that they wanted a copy of the actual Form1040 filed.

Granted this review was for London and not Dublin. It perhaps also depends on who's doing the interview.

We are getting my father as a co-sponsor.

Thanks again. The whole experience is so nerve-wracking and I'm just paranoid about everything.

Ah, I see. So the problem is that you don't have a copy of your 2006 1040? Are you able to obtain a copy? If you are, I would do so to put your mind at rest.

I think I've confused you and you're worrying about a problem that won't arise.

I was worried before I went to the interview that my husband's 1040s wouldn't suffice and I had posted a question here asking if I should take transcripts as well. In the end I didn't bother getting transcripts, and just took the 1040s, that's why I said 'they didn't want transcripts' - I was relieved.

Did that make sense? Your transcripts should be fine on their own, as were my husband's 1040s on their own.

Mike and Jill's I-130 timeline

13 Apr 2007 - I-130 approved

21 Apr 2007 - packet 3 received

23 Apr 2007 - posted packet 3 to Embassy

25 Apr 2007 - packet 3 received at Embassy PO box
