Hello guys

 

My husband who is now a US citizen petitioned for his mom, she case was approved by USCIS and forwarded to NVC. We are trying to submit a necessary documents so that her visa interview can get scheduled. We just need help with the I864 forms so that we can determine exactly which ones to fill out. What is your question?  "help with the I-864 forms" is nebulous. Do you need help with anything specific?

We are trying to figure out exactly which one of the I864 needs to be filled out since there is a I864 EZ, A, and W.  Also, since I am his wife, will I needed to be listed or complete any of the I864?

I-864 is the general form he will need to use if he doesn't qualify to use I-864ez.

 

I-864EZ is the simplest form, but can only be used if only your husband is sponsoring his mom, based solely on his current annual income (salary or pension), and she is the only immigrant your husband is sponsoring.

 

I-864A does not apply.  It is for a spouse of a joint-sponsor.

 

I-864W does not apply - it is an exemption claim due to the immigrant being under 18, having worked 40 quarters in the US, and other reasons.  Does not apply to your mother in law.

OK, so we would use the for I-864 since my income will also be included in the form to ensure we are below the 125% poverty guideline?

I-864A may also be signed by the spouse of the petitioning sponsor.  Doesn't just apply to spouse of joint sponsor.

 

I-864W is no more.
