Good day.

Please I'll appreciate a clarification on an issue I'm currently dealing with. 
So my husband filed for me since Feb and we got the approval from USCIS this week. However, he retired from his job last month as active duty military but has monthly entitlement of $1,700. 
Do we need to get a joint sponsor for the NVC stage or can we just proceed with his tax filing seeing that he still has a source of income though not as much as it was before retirement.

I urge you and your husband to become "A" students in the immigration process and the I-864.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hi,

 

Your husband's current yearly income is $1700 x 12 months = $20,400.  That is under the 125% poverty line for two people on the I-864p.

 

He can use assets to meet the difference.

 

IMHO, it would be best if he could get a Joint Sponsor if he doesn't have enough assets.

Thanks for this. Does the Joint sponsor have to be a permanent resident or a US citizen?

Too little information

many from military retire and work another job depending on age and # of years in military

if he stayed in to a "ripe old age " of normal age of retirement ,   he is eligible for Social security benefits also as states by the following in the social security guides:

 

so the following may mean more income than just military retirement

Military Service and Social Security 2020

 
You can get both Social Security benefits and military retirement. Generally, there is no reduction of Social Security benefits because of your military retirement benefits. You'll get your full Social Security benefit based on your earnings.
 
So you need to know
1.  is he working or planning to work a 2nd job? or
2.  Is he not planning to work and not eligible for SSA yet?
3.  is he old enough to claim SSA benefits? or
4.  was he married and former wife died and he can claim widow's benefits?
 
all the above figure into any answer the VJ community can give you

I worked after military retirement.....for 20 years.   Now, I receive my military retirement and my Social Security retirement.

that's what i meant

many retire and work as $1700 is just not enough to live on so new job as trained by military service

He retired based on disability while in service. He's not applying for jobs yet because he needs his leg injury to heal. So he is definitely planning to get a second job.

I know.  I was just just giving a personal example.  After I retired from the military, I immediately enrolled in a local university and obtained a degree in Nursing from the University of Arkansas at Little Rock a couple years later.  Then I practiced as a Registered Nurse for years....eventually getting some IT certifications and IT jobs, too.  I eventually fully retired in 2011.

complicates things

depending on injury ,  he could be eligible for SSI for the disability but applying and getting SS to approve takes at least 2 years (been thru this with my son) and a good SS lawyer 

but you have time as at the present Nigeria is on the ban list from the January 2020 according to EO from White House

On a personal note thank you for your service 

this is what i have seen over and over 

and to help this OP she needs to know extent of leg injury,  his education and training,  how soon he could work,  does he have a person that could be  joint sponsor,  etc

and that they do have time to talk this out and figure the direction they need to go as right now the ban is on immigrant visas from Nigeria according to White House site from January 2020
