Nick is here in UK so not working. He's travelling back in December and intending to start working. He has never filed a tax return as never made enough money due to only working wee part-time jobs since leaving school. Is this going to cause me a huge headache? His parents are being my co-sponsors and they have all their tax returns which list Nick up until last year as a dependant. We only just mailed out I-129f last week so we not expecting interview stage until at least Jan so he will have worked at least a few weeks by then, I know his income wont count but at least it will show he is willing and able to work. I've also read somewhere that London will take my savings into consideration too? Help I just want us to be organised for anything that USCIS or the embassy in London will throw at us. I can predict many sleepless nights over next 6-7months!!!

12/22/2007 - packet 3 rec. (12/28/2007 returned)

01/11/2008 - medical (allergic to tetanus shot, requirement waived)

02/05/2008 - interview @ 10am - APPROVED!!!!!!

03/12/2008 - Flying Glasgow - Dublin - Chicago - Omaha

05/31/2008 - WEDDING

AOS

07/31/2008 - AOS and EAD finally mailed

08/02/2008 - Delivered

08/08/2008 - Check cleared

08/11/2008 - NOA1's for AOS and EAD recieved (reciept date 08/07/2008)

08/16/2008 - Biometrics letter recieved

09/09/2008 - Biometrics at 1pm, Omaha

09/26/2008 - AOS transferred to CSC

09/29/2008 - AOS touched (took out envelope at CSC and put in new pile)

10/03/2008 - AOS touched (probably that RFE coming soon!!!!)

10/06/2008 - AOS touched AGAIN!!! (surely it's an RFE)

10/15/2008 - EAD CARD PRODUCTION ORDERED!!!!YEY!!!

10/27/2008 - EAD IN HAND

01/12/2009 - AOS touched

01/26/2009 - Email from CRIS. GREENCARD PRODUCTION ORDERED..YIPPPPEEE

ROC

10/25/2010 - ROC mailed

11/15/2010 - NOA1 and check cashed

He will still need to provide an I-134 and cite the specific IRS regulation that indicates he was not required to file tax returns. If he's been a student all or most of the past few years, they'll understand. If there is time for him to return, find work, and provide evidence he's working, that would help too. Yours is not an uncommon circumstance.

He will still need to provide an I-134 and cite the specific IRS regulation that indicates he was not required to file tax returns. If he's been a student all or most of the past few years, they'll understand. If there is time for him to return, find work, and provide evidence he's working, that would help too. Yours is not an uncommon circumstance.

We're in a similar position to you too. My fiance was a student until recently and he's never filed a tax return either. His parents are also acting as my sponsor. I didn't know that the UK's US embassy took our savings into account. I know that they did with the student visa, but not for the K-1 (I filed for the student visa in the UK and the people at the embassy were lovely. Filing this one in Ireland as we have moved out here now).

1999 - 2005 - Continued talking on a daily basis

2004 - T applied for student visa for semester of study in US

Jan 2005 - T flew to States to begin course

March 2005 - T flew to CA. D picked up at airport. Finally met in person!

April 2005 - T flies back to University

April 2005 - D flies out to be with T

May 2005 - Both fly back to CA and begin living together

Sept 2005 - T flies back to UK to resume studies

Oct 2005 - D flies out to UK to be with T - Decide we want to get married!!!

April 2006 - D and T move to Ireland

March 2007 - We download paperwork for I 129-F

April 2007 - Send off forms to Texas Service Center

June 2007 - Still waiting to hear back

July 2007 - Still waiting to hear anything AT ALL! Very angry

7th July 2007 - We called the USCIS and were given our receipt number. We also signed up for the USCIS online service. Learned that our petition arrived on May 15th and last action was May 25th 2007 - Much happier

4th October 2007 - Petition Approved!!!!!!

24 April 2008 - Interview at US Embassy Dublin

17 June 2008 - Arrived back in US together

10th SEPTEMBER 2008 - MARRIED!!!!!
