We are filing the I-751 for remove conditions on my wife's CR-1 visa. We understand that we will receive a I-797 that will extend her expiration for 18 months while they are processing the request. So, can she work and travel with the letter and her expired visa? Or does she first need a stamp in her passport? Thanks for helping us understand the I-797. Have a great day.

Her status continues....the expiration date of her card is extended for the 18 months.   She will need the letter along with the expired Green card for travel (re-entering the US).  She can work.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is not a visa. She is a permanent resident, and it is a permanent resident card.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thanks for the correction. Resident card not visa. The language is confusing. I actually used the word, "Green Card" with the USCIS representative on the phone today but quickly corrected myself. As everyone here can understand, this is pretty stressful, especially in light of the pending changes (fee increases).

Hi All, I have a follow up question and related situation:

 

My wife's i-797 is about to expire in 12 days. We're very concerned about whether or not she's allowed to continue working in the US legally, and if she is allowed to travel, while we continue to wait for our i-751 to be processed. For reference we filed our i-751 in December of 2019!!! And we've been waiting since then to receive any notification of action or a request for interview, my wife had her fingerprints taken in January of 2020.

 

Please advise! We've gotten some concerning and conflicting information from the USCIS today, who we were able to reach on the phone. Any help or further information is greatly appreciated.

August 3rd: I-129F Petition sent from the United Kingdom to the Dallas Lockbox.

August 16th: NOA1 Text and Email. Case sent to CSC

September 27th: NOA2 on USCIS Website and App

xx/xx/xx: NOA2 Text and Email

xx/xx/xx: NVC Received I-129F

xx/xx/xx: Case Number Received

xx/xx/xx: Embassy Received. Case status set as "Ready"

xx/xx/xx: Medical

xx/xx/xx: Interview

xx/xx/xx: POE at airport

@norman89 while the extension letter is about to expire, your wife continues to be a permanent resident of the US. Her employer does not need to reverify her eligibility for employment. She can just continue working. 

If USCIS waived her AOS interview, then you are looking at having an interview for ROC. Where is the petition right now?

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Thanks so much for your quick reply to my questions! That's reassuring to hear, we just spoke to USCIS and they suggested over the phone that she's not allowed to continue working once form i-797 expires!  Can you believe that?!

 

What about travel once form i797 expires for us in about two weeks? I understand there's a stamp she can get in order to leave and reenter the country while we continue to wait for i751 to be processed? Is that accurate?

 

I am not sure if the interview has been waived, from what I understand we're waiting to be called for an interview, and we reside in New York.

You have to keep in mind that tier 1 and tier 2 agents are not USCIS officers. They're contractors who are trained to answer questions. You might have gotten a new one.

What the agent said is not correct. Your wife does not have to quit her job and it is not legal for her current employer to re-verify her. She can just continue working. 

 

I would call USCIS to schedule an appointment at your local office to request the I-551 stamp. The stamp is for all purposes proof of her permanent resident status. USCIS usually gives it out for a year. The only give those appointments if your extension is expiring within 30 days. Now would be a good time to schedule it. 

 

Interview - if your wife came on k-1, and did not have an AOS interview, then you will have an interview for ROC. That's the current guidance effective 12/10/2018. Had they waived the interview, you would have gotten the green card or some status update letting you know that she had been approved.

DO NOT leave the US with an expired extension letter without having obtained an i-551 stamp.

If you do, it will require you to visit an embassy overseas and pay circa $650 for a boarding foil to enable boarding back to the US. You will be in a world of pain, so just don't do it.

An I-551 isn't just a stamp to leave and re-enter. It is a temporary proof of permanent resident status in the absence of a physical card, and is simply a stamp version of a permanent resident card. It clearly has 'employment authorized' in the stamp too, for the avoidance of any doubt. 

Again, DO NOT LEAVE the US without either a valid I-797 or having obtained the stamp.

Stamps are usually issued for twelve months, and yes, you will have to keep renewing as long as it is still pending.
