Dependent children on I-864?

hi again all,

Can you please tell me what we should put on the I-864 form for Part 5 Q21.

If my father in-law has 3 children including my wife but all children are above 21, should they still be included in "if you have dependent children" they are all working full time. But live at home with him.

If he cannot claim them as dependents on his tax return, then they are not included in the household size. If his income meets the requirement for his household size without them and he can't claim them as dependents on his taxes, then definitely don't include them. If his income doesn't meet the requirement, then the children and their incomes can be included and they would fill out I-1864A forms.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

If he cannot claim them as dependents on his tax return, then they are not included in the household size.
