Hi All,

 

My wife (petitioner) and I are looking into buying a house, but since I don't have my green card yet the lender says he won't put my name on the mortgage. This is totally fine for us, but I wonder if that would raise a red flag during our interview. If we didn't have a joint mortgage, would the USCIS officer think that our marriage is not bona fide? I can explain that this was due to me not having my green card yet but still the situation kind of sounds very sketchy to me.

Is a joint mortgage required evidence?  My wife isn't on our house.

I don't think it is a required evidence, but if the officer asks where you live and if it's rent or something and then you answer you are paying mortgage but your spouse is not on it, it would be a little bit suspicious.

Did the officer bring that up at all?

He asked where we lived.  Owned or rented.   Never asked anything about the title or mortgage and we didn't offer or explain either

What is your current status? Do you have a SSN? You can be on a mortgage even if you do not have a green card. I am on a H1B for many years and I am currently going through marriage based AOS. I have owned my own house before with only myself as the owner and on mortgage. I have also jointly owned a property with my wife (then girlfriend) before we were married. I jointly own the house that we currently live in and we both are on the mortgage.

 

I don't know the details of your case, but you can certainly be on a mortgage even if you don't have a green card.

RoC Timeline:

  1. 12/04/2023 - Application sent to USCIS Elgin, IL lockbox
  2. 12/07/2023 - Application received by USCIS
  3. 12/12/2023 - Received "Your case received" text message from USCIS. Receiipt # starts with IOE
  4. 12/13/2023 - Check cashed by USCIS
  5. 12/19/2023 - Received in mail the I797 with the receipt number and the online access code
  6. 12/19/2023 - Received in mail the bio-metric re-use notification
  7. 12/21/2023 - Received in mail the I797 NoA extending my green card by 48 months

I don't know the details of your case, but you can certainly be on a mortgage even if you don't have a green card.

Thank you very much for the info. I do have a SSN and am currently on my academic training (J1). We are working with a local lender who is probably not very knowledgeable. So, we will likely go to a bigger lender in that case.

Anecdotally, I felt a shift in my AOS interview when the officer asked where we lived, rented or owned and she asked my then-husband "But you own the house and you both live there?" and he responded "No, we both own it" and pointed at the deed. She smiled and started joking around, I felt like that question tipped the interview for us but we didn't have any red flags to begin with.
