Good morning everyone around the world! i know there is a pinned article about "yes you can visit" however this is prior to covid. i know some people have had success visiting. Anyways, my Visa is AT NVC, and will most likely be there a while. id like to have my fiance over soon if the boarders open in PH. If i have employer notes from both of us, proof of her bills in PH, Round trip ticket, proof of relationship, ect what are my realistic chances of being turned away being that its already at NVC. Our I-129

I know it will absolutely vary from person to person and depends solely  on the immigration officer. However just looking for a general estimate on what people think about this. How has immigration been with pending visas during covid?

Does she already have a B2 visa?  If not, the chances are very slim for getting one.  If she already has a visa, she should be prepared to show STRONG ties to PI.......proof of relationship and your employment letter are strong ties to the US......not needed, and could harm chances for entry.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes she does! She has been to the USA about 6-7 times. Never over stayed and always left WELL within the limit. usually 2-3 weeks at a time. ill look into some more forms of strong ties to PI. if my employer made a letter stating that i would be out from Monday xx.2020 untill friday xx,2020 and have them state for the reason of taking time of for my visiting fiance. Also having her have a letter saying the same thing but from her employer. Something like that could still hurt? or just leave mine out for the time. Again this is all hypothetical until they open the borders. Thanks for the advice. We are weighing out pros and cons and chances of what to do. If she can leave for "non essential" travel. worst case we may have to meet up in a third party country.

If she already has a valid B2, then I would expect her to have no problems......just take evidence of ties to PI in case she is questioned.   I would not include anything from you.  Good luck.

Thanks! i really appreciate that! Ill discuss that with her as well, ill just have her focus on ties to PI instead of anything to do with me. Appreciate the help!

Thanks for clarifying! If we decide to go this route (if and when PH decides to allow for outbound travel) we will treat it as normal.  :)

I was going to point out that she can't even leave the PH, so it's good that you're already aware.  If by some miracle the outbound travel restrictions ease up soon, please skip the proof of relationship and letter from your US employer.  Instead, have her bring the I-129F NOA1 letter, in addition to her proof of ties to home.

 

As always, answer truthfully when asked by CBP, but don't volunteer information that was not asked.  So don't show the NOA1 unless CBP brings up the need for a fiance visa.  The NOA1 can help to persuade them that you are following the legal process for immigration.

 

Btw, pre-COVID, I was sent to secondary interview after I told CBP I'll be staying with my boyfriend (now husband) during my trip.  They let me through after around 5 minutes of questions.  They didn't look at any of my proof of ties, but they asked a lot about the work I do back home, not so much about my boyfriend.

So now that there is SOME talk of outbound, (inbound sounds very unlikely now for this year) we think we will try our chances.  roundtrip ticket, I-129F with NOA1 and NOA2, letter from her employee, letter from her contractor who is working on her mothers house that she is managing the project, bank statements, bills like electric internet cable ect on 2 properties.  Over 4 years she has been here 5 times to the states. each time staying less than 1 month which is on her passport.  She will have the accredited hotel booked prior to travelling. Also she will be getting a swap test prior just in case. Manila to JFK through PAL. 

 

What else can we provide for strong ties to PH? i know its really up to the IO at the time, and she wont provide anything not asked for, but i want to be prepared for if they do want more evidence.
