Asking for a friend.....ir5 visa......NVC stage....

he is trying to expedite his case After Donald trump proclamation is done.....  due to financial Hardship due to COVID-19 affecting the whole business in town... Has already turned in affidavit of support which already got accepted...will finiacial hardship ruin his case/affidavit of support?

We need more information. Maybe have your "friend" create an account so they can give us the full story. Please read your paragraph again and see if it provides all the info. What country is he in? Does his annual income fall below the 125% guidelines? What proclamation are you referring to? Is he just wanting to expedite his case for the interview? If so, requesting an expedite won't ruin his case.

The USC is trying to expedite by claiming financial hardship and also sponsoring an immigrant?  Yes, that can pose problems.

He doesn’t want to make an account that’s y I’m asking. 🤦🏼‍♀️  Hes here in US HAWAII...   “proclamations 10014 and 10052” banning SOME immigrations From coming to the United States.

annual income is 70k...he already submitted his affidavit and is accepted by NVC... but when this COVID affected all jobs on our island he is currently dealing with financial hardship. He Just wanted to expedite for an interview .

i don’t know if this will affect him or his parents since he already got his affidavit accepted?!

Yeah... but he already got his affidavit accepted By NVC .... but now dealing with financial hardship...since mostly everything is closed here in our town... Just trying to get a earlier interview date...

If he can show that he is sending money to his lady or that he has expenses in two places, Manila will approve the expedite. He sends the request to NVC and they forward it to Manila. It has nothing to do with his current income. If they deny the expedite, it won't impact his case. If they approve it, he'll get an interview date sooner that all the other people in the queue. As long as his current income is high, he is ok.

OP is IR1 but he states friend filed IR5. Not sure how he’ll prove not having parent here is causing financial hardship.  Seems like a stretch.

Ah, true. I did remember looking that up. If the "friend" is sending money to a parent, Manila could see that as a burden. It really boils down to each consulate. I've seen members on here get approved for spousal visas early because a birthday was coming up. Parent visas may have a different priority, but there is no harm in requesting an expedite. It will not hurt you in any way.

Yeah.. I currently have a i130 application for my spouse.. I was just asking for a friend cuz he has a ir5 for his parents..

You may want to tell him that there is a ban on that visa class currently, so no expedite will happen until after the ban expires.

That will be hard to get an expedite for parents due to financial hardship. What are their ages? Are they coming here and working or are they elderly? What about healthcare?

Anyone can request an expedite so you can tell your friend if he has the proof for his case go for it. If approved he will sit in line until the ban is over.

I personally think this has the potential to backfire. They are getting more stringent on sponsorship for parents re healthcare costs etc. There would have to be a very clear indication of how getting the parents here would so significantly improve his/her finances to also be able to overcome public charge concerns. Unless of course they have a joint sponsor. The interviewing officer will obviously have access to the expedite request and reasons in it. Entirely possible they will ask a new affidavit of support under those circumstances.

I agree with the above - it has the potential to backfire here.

Bringing parents to the US is often...and almost always compared to PH COL...more expensive. Costs will very likely only go up once they are reunited...healthcare coverage alone can be 4 digits. Are they of working age and capability to find employment within the US for at least 10+ years (for premium-free Medicare Part A coverage)?

 

NVC only reviews documents. The CO makes the public charge decision prior to issuing the visa.

Timeline

1.  Why expedite?  You said your friend already submitted AOS to NVC and was accepted.  I assume then that his parents' cases are documentarily qualified?  If so, then they will get an interview next year when the proclamation is over, as long as it is not extended.

 

2.  Financial hardship will be very difficult to prove, especially, as others have stated, his financial situation will more than likely get worse when his parents arrive.
