Team,

I would like to know if one can request to expedite I-130 on the basis of Job loss. My husband has lost his job due to current economic scenario and he has no income. I am the petitioner a USC and my husband is in his home country. will this reason be enough to request an expedite? Please help.

Thanks...

Yes you can, may be a difficult case to make.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

It would not hurt your case to try, but set your expectations low.  It's unlikely this reason will be accepted as expedite requests based on financial reasons are usually granted to alleviate financial loss on the part of the USC petitioner, not the beneficiary.  I hope you come back to update us on how it turns out.  Good luck!

It costs nothing to ask and there is no harm in asking. However, many people all over the world have lost their jobs lately due to COVID-19 and not everyone can be expedited. But there’s no reason not to try and hope for the best.

The challenge with an expedite request in your situation is that you are his primary financial sponsor, or you have a co-sponsor who can support him financially after he arrives.  Your case centers on the idea that if he comes here faster, he can work and help to support himself, but this may backfire because you and/or co-sponsor have to prove that he will be financially supported without working.  No harm in trying, good luck!

Thank you all for a candid feedback. what i didn't understand is the 'backfire' statement. As we all know that beneficiary will someday comes to US and during that time he will have no job until he receives work permission. so, In that case i have to support him financially till he gets the job. Please correct if i am wrong.
