I understand, i means that he can contact the border and fix the case.

No, a lawyer cannot "fix" the fact that your previous visa was revoked.  That's always going to be on your record.

The most that a lawyer can do is to help you prepare for your next visa application.  That's it.

Wonder if this is all a cultural misunderstanding.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Sounds like you’re not familiar with the doctrine of consular nonreviewability.

*POEs are not consular posts, though. While CBP decisions are also generally not reviewable by any judge or court, it is possible to submit a request for review to CBP directly.

Hello all,

i am new here reading and learning.

SO to boil it all down, once someone gets denied POE and their visa is revoked under the clause mentioned there is nothing one can do?  No letter of forgiveness no petition for pardon.  Nothing but serve out the 5 year sentence and wait to apply again and see where it goes?  I just want to get a definitive answer.

I 212 is the waiver for being deported.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

That is for having inadequate documents, you can not waive that.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

This has nothing to do with your Canadian Passport.

Inadequate not false.

i asked because in the canadian passport form they ask if i was charged for false declaration outside of canada.

I dont know if the visa revocation is considered as false declaration since that the agent write: misrepresent himself

Hey Tommy22tn,

Looks like you are still having difficulty with this more than a year later judging from your follow up question on Oct 15th. Have you considered consulting with an immigration lawyer? Many have free consultations.

Also, you mentioned back in Sept 2020 that you were a permanent resident of Canada but got a Canadian passport later. Have you tried crossing the border with your new Canadian passport? See below if any of these apply to you. Canadians generally do not require visas to enter the US. Not sure if this apply to you….I recommend to actually talk to an immigration lawyer so that you do not get into further hot water with the CBP.

Yes once you have a Canadian passport you should be fine to enter the US without a visa.  They will still find you in their system at POE so be ready for an explanation of what happened in case you get questioned about the cancelled visa in your Tunisian passport.  If you need to visit the US before you become a Canadian citizen, you'll have to reapply for a visa, which may take a long time because of the backlog due to the pandemic.  Good luck!

Hi there,

i recently got my canadian citizenship and im planning to visit US for the new year.

a US lawyer told me that i need a waiver before trying to enter US (even with my new nationality), an other one told me that i dont need that but they qill maybe asked me some questions about my previous b1/b2 visa revocation.

what do you think there?
