After getting CR-1 visa how long do you have to get to the US

How long do you have if your living oversees to get to the US once the visa is issued? i.e. how many months can you stay oversees before you have to depart for the US?

Another question I have is if you are working oversees, can your income count for the I-864? I am planning on living overseas with my spouse for a little bit and do not know if the income will be enough, so more than likely I will need a co-sponsor.

Another question... Can I use my parents address as domicile?

an immigrant visa is usually valid for a maximum of 6 months from the date of issuance. you must travel to the us within that 6 month period or else you have to start the process over.

01/17/2007 Faxed the checklist to the Immigrant Visa Unit in Frankfurt

03/29/2007 Got letter from USCIS to provide evidence that our marriage is bona fide

04/02/2007 Sent to USCIS lots of evidence

05/03/2007 I have an unofficial "PETITION APPROVED" ...waiting for confirmation from Consulate

05/07/2007 Received email from USCIS ROME confirming that our petition was approved (why Rome? because we complained to the District Office Rome about the Sub-Office Frankfurt..it took too long for our petition to be approved)...now waiting for the interview letter from the Consulate

Six months is correct.

You cannot use overseas income unless it will continue when you return to the US. If you won't be in your spouse's country for long, you probably won't have a domicile issue. As long as you continue filing tax returns and keep American accounts open, your parents address should be fine. It can vary between different consulates though so I would check with someone who went through the same consulate.

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
