Apologies if this is asked before. I tried searching but found nothing.

 

for evidence of a marriage in good faith, is a sworn affidavit from family/friends really necessary? Is it one of those things that if you don’t have it’ll really count against you? I can easily get one from my parents but not sure it’s needed. TIA

I've seen cases where none was presented and the case was accepted. If you have strong evidence then i dont think it's necessary. In my case I did submit 3 letters and I guess it helped.

If you have good evidence of financial co-mingling, and you have good evidence that you live together (both names on lease, both names on mortgage/deed), then affidavits are not needed.  They are useful in the following circumstances:

 

1.  You live with family or friends and do not have a formal lease/mortgage.

2.  You live separately at the moment because of job/school/other circumstances.

3.  You are of vastly different races or religion (sorry about this - but it is true).

4.  Your age difference is unusual.

 

Affidavits are really considered tertiary evidence.  Financial co-mingling and living together are the big keys.

 

Best of luck.  We did not submit any affidavits.

this says K1 so will you be doing CR1 for marriage?

 

you need to have the following

 

 marriage certificate accompanied by one with English translation

. a few wedding celebration photos if you had one after signing marriage documents

proofs of joining expenses and assests

 

 

u need to not have

1.  big age difference

2. prove you live together like state ID or drivig licenses

3   same religion is a plus

had to edit as i made the mistake of not looking at previous posts and didn't realize this was AOS

Why would differences in race matter? Religion, yes, makes sense, because many religions don't allow marrying outside the faith but race is irrelevant.

Assuming you are at the ROC part. Affidavits are not required.

Nowhere in the instructions does it say they are. It just lists them as an example of what you could sent in.

They want evidence that you are a couple. Most people use financial evidence for that and back it up with some other day to day info.

We got approved without any shared finances (though we file tax married) or any photos and no affidavits. But I did include a bunch of stuff of me with the kids (from her previous marriage).

We did get an interview, but that was because we did not have one for the AOS and they lost a bunch of stuff from my file.
