Minor confusion with I-944

In case of I-485 for a spouse (beneficiary), is I-944 Part 1 to be filled out by the petitioner (US Citizen) or by beneficiary? I didn't see this explicitly stated in the instructions, but I'm guessing beneficiary? Also, for household assets, can we list petitioner's assets (real estate, bank accounts) even if the beneficiary isn't on the mortgage or given bank account (because they were obtained prior to marriage)? For information regarding tax filing, do they only care about US or beneficiary's home country as well? It's kind of problematic for us to obtain tax statements from beneficiary's own country while within US and petitioner's income is high enough to not need it.

I'm not sure who is adjusting from what (your timeline says k1 but you posted in the adjustment from work, student and tourist visa forum) but AOS is not like the k1- there is no separate petitioner and beneficiary.

In adjustment of status there is only 1 petitioner/beneficiary- the immigrant. This would apply to the I944 as well- the immigrant fills this out.

The household assets would be the assets between the husband and wife. They don't care about foreign tax statements (and not every country files taxes..) they are looking for taxes filed in the USA.

In regards to the assets- the immigrant does not have to be named on them as long as a household member is named on it. Make sure you submit proof of the assets as well.

I'm unsure if you reviewed the instructions but it may be helpful to- https://www.uscis.gov/sites/default/files/document/forms/i-944instr-pc.pdf

What about foreign bank accounts. Do they need statements of that?

True. Thanks. I have also doubts about the debts in your home country since they say this. I have a 10K debt in Spain that I guess will play against me if I list it:

Liabilities/Debts Item Number 10. Liabilities/Debts. Provide a list of all your liabilities or debts. Examples of liabilities and debts include mortgages, car loans, unpaid child or spousal support, unpaid taxes, and credit card debt. Provide documentation for each liability or debt. If you need extra space to complete this section, use the space provided in Part 9. Additional Information.

You still need to be honest and list it.  Otherwise you are perjuring yourself.  Not a smart risk to take.
