I am using Rapid visa and I completed a Affidate of support with my last 3 years of tax returns and my employment. When she goes for the interview at the Chinese consulate will they contact my employer? After doing all of this, i got laid off at work and I am collecting unemployment. Not sure what to expect now especially if I don't find another job before the interview.

They don't have time to contact employers.  Often times they want to see a recent paystub but time will tell what they need

No, they will not contact your employment but you also can't go in lying saying that is your current job/income. You will need a joint sponsor if you can't find a job in time.

Please complete a timeline so we  know how far along you are in this process and can give the best advice 

 

Example if you are about to have an interview,  you need to prepare for joint sponsor

if you are a long way from interview,  you need to have a new job

They won't contact your employer as you will submit the most current financial information which include a recent paystubs. It would be in your best interest to secure a co-sponsor and they will complete the same paperwork and forms as you for the interview. It's not unheard of this happening to others because of the covid virus so, be sure the beneficiary is confident in your re-employment possibilities and that you have a co-sponsor. Good luck and stay engaged.

The I-864 is signed under penalty of perjury.

Presenting a knowingly inaccurate I-864 would be a misrepresentation.

 

If the I-864 was already reviewed at NVC and you got DQ, technically that remains valid. But often they want you to bring an updated copy to the interview, and doing so while unemployed will not be sufficient. They also tend to ask about the petitioner's employment, of which you would need to be honest.

If the I-864 has not been reviewed by NVC yet, then you'll need to resolve this before submitting to NVC.

Resolving this means either obtaining sufficient income/assets, or finding a joint sponsor.

I-864 is for CR-1/IR-1 but I-134 is for the K1 which visa we don't know yet which the OP is processing. Of course, @geowrian knows this. :)

Ah, thanks. Then just the I-134 at the interview then. So it needs to be current...meaning they need a job or co sponsor.

Right now, its at NVC. I completed the affidavit of support online at Rapid Visa. From what I understand, they will be setting a date for interview at Chinese consulate in China. I lost my job after doing the affidavit of support, I am getting $2500 a month on unemployment, do they count that as income

Hey sorry to hear you lost job...

We had diverse situation from you...my housband in past 3 years was reciving workers compesation due his work injury and 3 surgeries... Rapid visa advice us to get joint sponsor even tho we were at Nvc DQ...this year he started at new work and we were approved without joint sponsor...even with cr1 visa they looking current income for approval

Are you pursuing K1 fiance or CR1/IR1 spouse visa?  For K1, there is no need to submit an affidavit of support to NVC.  The applicant brings the I-134 to the interview at the consulate.  For CR1/IR1, the petitioner submits I-864 to NVC.

 

In any case, unemployment checks will not qualify you to sponsor an immigrant.  Get a job before the interview or find a joint sponsor.
