My wife, who arrived here on a K1 in February, filed for AOS with a Priority Date of February 28th.

 

We received an RFE in June for the I-944 form (mistake on USCIS’ end, we postmarked before the cutoff date). We promptly responded to the RFE.

 

Since then, not one peep from USCIS. We figured that we would at least have a biometrics appointment by now, but nothing. And no movement on the EAD, either.

 

We are panicking slightly because many February filers have received EAD approvals, or at least have had biometrics. It just feels like our application has gone into a black hole, and continuously checking the mail every day to an empty box is getting very frustrating. 

 

We know that the RFE may have set things back, but thought processing would resume as normal once we replied. Calling USCIS never leads anywhere. They basically read us what the status checker says and that’s where it ends.

 

Does anyone know what might be happening here? Help?

Covid has added time to processing, for everything.  EAD/AP approvals, which previously had taken 4-6 months, are taking longer.  You are likely still within revised processing times.  Of note, the I-944 has been reinstated, retroactively.  If you did not respond to the RFE by submitting that form, you will need to submit it asap.

We responded to RFE by submitting the I-944. Sucks it’s been reinstated retroactively, though.

Our cousin filed in February and their biometrics appt got cancelled in March and things have gone silent for them since. I’d be curious to know what Feb AOS filers have already received their EAD.

The RFE puts the EAD on hold. Expect the EAD to be approved and delivered a coupon weeks after you get the Ready to Schedule update.

I got my EAD almost a month before "ready to schedule for interview". I think (as with most USCIS things) it depends on the specific case.

The AOS from K1 February topic is full of them. Some have been approved for quite a while and got their cards as soon as they had biometrics done.

Thanks I'll check it out. Unfortunately their biometrics got canceled in March and has yet to be rescheduled.

I filed for AOS last year in June, I’d say you’re still well within processing times, especially considering the delays due to covid. My interview should’ve been in March but was postponed and now I finally have my interview next month 16 months later from the application

We are required to file I-944 now? I sent my AOS package in without it.  It was delivered on Tuesday. 😳😳

It was just reinstated.  I would just prepare it now, and you can even try to send it and see if it gets matched up with the form.  If it does not, you'll get an RFE, and it will be ready to go anyway.

 

Btw, I personally added something to my K-1 petition (I-129F) 4 months after sending it to the USCIS.  I sent my addendum directly to the CSC in Laguna, and it was accepted and added to my file.  

 

The standard word around VJ is that this doesn't work, and it may not commonly work, but I did it.
