Hello all,

 

I am wondering if anyone can help me?  My fiancé has recently sent of the paperwork for the I-129 and included my sons details in the papers.  We are a long way off the various stages, however querying if/when Visa's are granted if my son can travel around a month later without me when he will be 16.  We don't want to consider a follow to join K2 visa, and are just planning for his exams and results collection next year which could impact his ability to travel at this time.  

 

Any advice would be gratefully received.

A month or so later is not going to be an issue. You seem to have done some research on this- The 'follow to join' process is basically where you DONT apply for the K2 when you apply for your K1. You must apply for it with in 1yr of getting your K1. Your child must be unmarried and under 21 (when visa is issued) to qualify as well. The follow to join process is appropriate if your child needs an extended period of time before coming. 6 months to 1 year. If you dont need that much time you dont need to do follow to join. You can apply for the K1 and K2. Your K2 child can enter after you do (but not before). The K1 and K2 visas will be issued at the same time typically. Of course odd things happen where the K1 will be approved and a few days later the K2 but generally they are approved/issued at the same time. Your child will have 6 months to use the K2 visa. So you guys can get the visas issued Jan 2021 and you can enter Feb 2021 and your child can enter April 2021 or May 2021.

@Villanelle Thank you so much.  Yes we have been researching but didn't come across this type of situation but now we have some clarity that is great as it helps with all the planning.
