I-944

I understand that at this points 3 states are not requiring the I-944 and it seems to be a grey area on whether or not that form is actually needed from other states. I am applying for permanent residency after marrying my US citizen husband and am currently in the US. 

 

We just found out that it asks for education equivalencies. This could take awhile to get which would put us past the expiration date on my I-94. 

Are these forms absolutely mandatory and can I submit copies of my transcripts and Teaching Degree Certification? 

 

We are very conflicted as what to do for this portion as there seems to be a lot of different information about it.

UPDATE: On July 29, 2020, a federal district court briefly halted implementation nationwide of the new DHS public charge rule (including use of Form I-944) during the COVID-19 national health emergency. Then on August 12, 2020, the Second Circuit Court of Appeals limited the scope of the injunction to just New York, Connecticut, and Vermont. Most recently, on September 11, 2020, the Second Circuit granted the government's motion to lift the injunction nationwide, which means that now USCIS can apply the new rule and require Form I-944 in all states. See our public charge page for more information.

at some point it was going to happen.   Since it is retroactive, better now than later.
