For Canada you will need either a court order allowing you to move the child(ren) to move permanently to the US or a letter of consent from the other parent. 

 

The letter is simple. 

 

Something like I (parent's name) give consent to (other parent's name) to take (child's name) to move permanently to the US. 

 

Sign date and phone number

 

 

For me I got the letter of consent and my lawyer did not trust my ex to pull a fast one and had the letter made into a court order. This way he could not take it back on a whim. It was just a matter of her knocking on the judge's door and had him sign off on it. Then the court typed me up an official order. 

 

Many countries Sole custody is all you need but this does not always work in Canada. As sole custody does not remove the other parents rights like some countries. It sure is not the same in the US.

I just went through this in March.  

 

My ex and I do not have a formal court agreement for custody (or conservatorship as it's called in some places) of our children.  In one sense, being able to adult and make decisions in the best interest of the children without the interference of the court creates additional challenges, but in another, as long as you get along, it can be easier.  In this case, he was in agreement, so it was easier.  

 

I had a notarized letter from the childrens' father, certified and sealed by a lawyer, that stated the following: 

 

To Whom It May Concern:

I, <full name of parent>, father to <full name of child 1> and <full name of child 2>, consent for my two children to emigrate to the United States of America on a permanent basis with their mother <my full name>.    

 

At my consulate interview in March, I was asked to provide it and it was scanned into my file.
