Hi,

I have once again returned to my visajourney family for help...

Here is my situation. In 2015, I sponsored my mother. The entire process went smoothly and she received her permanent residency status within 8 months. She stayed with me in the US briefly, but due to a family tragedy back home, had to travel back. Since she had ended up spending more than a year in Pakistan, we assumed that her residency status would be deemed abandoned. Now, after 5 years, I plan on sponsoring her again and am a bit rusty on the process. What do you seasoned members think? Would her previous abandonment have any bearing on a new application. Is there anything else I can do to expedite the process? I was advised the SB-1 application, but we really don't have a reason to show that she was out of the USA for reasons beyond her control. Also, are the I-130's online or still paper format?

Thanks you all for valuable input and advice.

hi

no problem, she will start over, she will retain her alien number, meaning her green card and social security number, those numbers are for life, so anywhere that the numbers are requested you put those there

there is nothing you can do to expedite, it will take over a year. you have both options to apply for the i130, either by mail or online

I would just add that the IR-5 visa class (parent of a USC) is currently banned until at least the start of 2021. This may or may not be extended. Even if not extended, there may or may not be a considerable backlog of existing applicants since visa services were suspended in March.

The ban only impacts the visa interview scheduling and issuance, not the I-130 petition. So the sooner you file, the sooner you'll get to the interview.

Thank you for your input. I will from time to time return to seek further guidance. One more question. I read up somewhere that in order to re-apply for a green card, a form needs to be submitted, to acknowledge abandonment of  previous residency status. Is that necessary? Or can I simply re apply and the system will automatically pick up our situation? Thank you.

A Number may not be the same. We were LPR 1980 through 1990 and  were issued with a new A number when we applied again in 2015

She should voluntarily relinquish and return her GC using the form I407. This must be done face to face at the consulate so she may need to wait  until they are open and she can get an appt

It can also be sent to USCIS in the US, albeit obviously that will be a slower confirmation process (the revocation still happens, but it may take longer to get official confirmation of it).

Where to File

Mail Form I-407 to the Eastern Form Center.

For U.S. Postal Service (USPS):

USCIS Eastern Forms Center
Attn: I-407 Unit
PO Box 567
Williston, VT 05495

For FedEx, UPS, DHL or other express/registered deliveries:

USCIS Eastern Forms Center
Attn: I-407 Unit
124 Leroy Road
Williston, VT 05495

In very rare circumstances, a USCIS international field office or U.S. embassy or U.S. consulate without a USCIS international field office may allow you to submit a Form I-407 in person if you need immediate proof that you have abandoned your LPR status. The most common need for an expedited application is to apply for an A or G visa. You may also submit Form I-407 to a U.S. Customs and Border Protection officer at a U.S. port of entry.

Don’t forget to sign your form!  We will reject and return any unsigned form.

So, until the Green card is relinquished and LPR status revoked, I cannot initiate another application? Atleast that's my understanding. The US embassy has restricted its services in Pakistan(and I am assuming in the rest of the world as well) since March, due to the Covid pandemic and since my mother is presently there, she would not get an appointment to appear in person.

Send it in, no need to delay with filing.

I kept my alien number and social security number is the same from the 70's

I had a green card as a child and when my dad passed away we returned to Argentina. I lived 25 years in my country

my mom became a USC and she filed for me, on the i130 where it asks for alien number if any and social security number if any, we put the same as I had back when I got my GC. those are still my numbers

Dear friends,

I am almost done preparing the documents to reapply for my mother's I-130.

Now, Since I am currently not working and taking some courses, would I need my wife as a co-sponsor to sign any forms or submit any documents while filing the I-130. I was assuming that would come at a later stage once the I-130 is decided upon. I came across certain questions where, I am being asking about my employment and wanted to seek advice here at visajourney before submitting the application. Since I have opted to file online, I want to file as accurately as possible with complete required documentation. As has been advised earlier, I am filing the I-130 and will file the abandonment Form 1407 for her previous green card subsequently.

Thank you for your input in advance.

hi

no need for your wife's signature, you are filing for her, the affidavit of support comes in later. if you're unemployed, put that, it won't affect the i130. it is a form to establish relationship between you and your mom, your financial situation is irrelevant for the i130
