My husband is the US Citizen and I am the principle immigrant (his wife from Canada). 

 

Part 3, #4-28. I have no kids and he is not sponsoring anyone but me. I just want to make sure that because I (principle immigrant) is listed in part 2 that I can leave these spots blank and in #29 just put '1'?

 

Part 5, #1-3: I am the principle immigrant (wife) so #1 = 1. My husband (yourself) so #2 =1. BUT number 3 states 'if you are current married, enter '1' for your spouse." It says not to count any member of the household more than once, so I want to make sure that it is okay to leave #3 at zero. We are currently married, but my spot is entered into #1. I don't know if that makes sense. 

 

Part 6: I (the principle immigrant) still have money left in a bank account that we are using but my employment in Canada has ended, so I am no longer receiving pay cheques. As a result, do we not include my income under Person 1? 

 

I am then unsure of how the previous question relates to number 21 and 22 and how they should be answered.

 

When getting tax transcripts we found out there were multiple kinds (account transcript, record of account, tax return transcript, wage and income). What one (or all) do we need to submit? Do we need to submit a transcript for each of the 3 most recent years (2019,2018,2017)? 

 

How do you find out if the income exceeds the Federal Poverty Guidelines?  

 

A question separate from this form but that I have on other forms. 

Quite a few other forms ask me what my current immigration status is. My paperwork will be filed before the I-94 expires, but not by a huge amount. So once it is filed there will come a date where my I-94 will be expired. Because I am a B2 visitor at time of filing can I write that as my current status?

Read what's above question 2 again to understand why the answer to question 3 is 0.  You mentioned you don't have kids, but if your husband have any unmarried children, it needs to be included as well.

 

You only need to submit the latest Tax Return Transcript, no need to submit 3 years.

 

Current income is key. What's his salary now? Or does he get paid per hour?

 

The "overstay" shouldn't be a problem.

Your US citizen husband should complete the I-864.  He is the one who has to sign it and make the commitment to support you financially, so he needs to know what he is signing and most of the financial information is his.
