Pending Divorce /I-751 Paperwork

Hello, 

 

I have a question regarding the I-751 paperwork. So my divorce has been filed but it's still pending. I'm currently filling out the paperwork getting ready to submit it in the next few days. 

 

On the first page is asks about marital status, I'm obviously still legally married so I check married, correct? As it's not ended yet, I also put N/A in the date ended because it's not yet finalized therefore there isn't a divorce date yet. And then on page 3 I would simply put a waiver request under good faith and then wait for the RFE for the divorce decree?

 

 

Sorry if that sounded wordy or confusing.

 

Any insight would be greatly appreciated.

Also as i'm looking to file as a divorce waiver, my spouse (soon to be ex) doesn't need to fill in part 8 does he?

Yes. Mark as married in your status because your divorce is not final yet. And check waiver good faith in page 3

In terms of part 8, he (the US Citizen) doesn't need to sign anything right?
