The lawyers for the K1 suit said that just the filing of the lawsuit would be enough for at least some embassies to start pushing forward the plaintiffs’ cases. It doesn’t matter if the hearing was done or not because the mere filing is enough for some embassies to not want to deal with it and just get the plaintiffs’ cases done.

I'm so over this convoluted process. Them pushing the folks part of a lawsuit before all of us that have been patiently waiting for interviews for almost a year now just blows my mind. I'll stop writing now before I say what's really on my mind. 🤐

Does Montreal want to have lawsuits coming out the wazoo? Because this is how they get them. If it does turn out that they are prioritizing certain K1 cases just because they were part of the lawsuit and spousal suffers as a result then this will be the second time K1 has be given priority over spousal in just over a year and I think that'll be a breaking point for many people.

It’s frustrating for sure. I decided not be part of this lawsuit but I really do feel for those waiting for spousal interviews. You guys should definitely be highest priority, especially considering the massive spousal backlog that already existed pre-Covid

Hopefully like @pooj97 said there’s only 2 from Canada. But this is alllll so frustrating. Last summers shutdown of interviews that only affected spousal but not the k-1. Then Montreal should have resumed the spousal visas earlier as per the june 22 proclamation but they didn’t...waited another 2 months at which point they also started the k-1s as well so now it’s at a standstill again. 
Hopefully we hear by next week.

How come K1 wasn’t impacted last summer? And just spousal?

Yup, I'm waiting until the end of next week to get mad 😛 There's no point in getting upset about it until we know for sure if it will affect us or not.

No one knows why spousal were stopped in the first place so there's absolutely no way to know why K1 weren't affected.

I get the frustration I'm near my breaking point with this process too, but there are many very valid reasons that this person may have received their P4 interview today - one that was drawn out in the facebook group is that they have the oldest PD in the group of K1's currently awaiting P4 at Montreal.  If that is the case it would make sense they were first and others will follow in the coming days.  In the grand scheme of things I don't think there are very many K1s awaiting P4 (compared to cancelled spousals and cancelled K1s) so they should be quicker to reschedule if they've chosen to reschedule those before offering dates for new spousals to NVC

I hope this lawsuit brings transparency to how they process anything. It seems like unless a case file is front of an 'officer" nothing happens to it. We don't even know what happens if officers who review cases go on vacation. Do the cases they are assigned just sit there? There needs to be an audit of how they process cases from start to finish.

The reality is based on how both processes interviews are handled k1s who are "DQ" should have recieved new info before ir1 and cr1. Ill wait until we normally would get our interview dates before jumping to conclusions. Considering how bad aos has been this year I dont envy any k1s.

I’m glad people are starting to talk about suing the Consulate here, since they are running way behind from staying closed longer than reasonable and now are prioritizing K1s over spousal interviews, which just doesn’t seem right. Not to mention the financial and emotional damage they are doing. I would consider joining a class action if others are interested.  I don’t really know where to start, but perhaps others have investigated the process?

My husband told me that the issue was because the consul at the time just didn’t care about doing her job. She is a socialite and was spending more time away from the office and Canada altogether.

She was under investigation last summer and resigned shortly thereafter.

He read something about it somewhere...
