If they're giving interviews to those that are waiting for/already have P4 then they MUST be planning to do spouses at the NVC too since that's effectively the same as being DQd.

They basically skip the NVC. Their case gets sent there but they don't upload any docs. The NVC send batches of cases to the consulate who then send the applicant an email (P3) letting them know what docs to email to the consulate. Once those have been reviewed they send another email (P4) telling them that they can schedule their interview. Then it's up to them to keep an eye on the calendar for any available interview times.

Very interesting, thank you for the explanation! I hope that they don’t forget about CR1 since they already have many K1 files in their hands to look at right now..

The person said end of October. They might be waiting to give us (spousal) more in November. They might be using october 28 for the new (P4) fiancé. Hopefully we will hear something next week!

That's good for K1 folks, but I'm getting REAL IMPATIENT NOW. They need to start looking at spousals now too!

Timeline

The K1 applicant who got their interview scheduled today is part of a 150-person lawsuit that k1 applicants from many countries filed for back in August to get embassies to start processing K1 visas again. I’m 99% sure the reason why this K1 applicant got their interview letter today is because they are part of this lawsuit. The rest of us K1 applicants are waiting (impatiently) along with spousal applicants too and I’m sure we’ll be hearing about it around the same time.

This is correct! K1 applicants skip the NVC and DQ process altogether. Once our petitions are approved, it does go to the NVC but we don’t get DQ’d or anything there. It’s basically a transit point for us to get our case number and it stays there for 3-4 weeks MAX until the shipment date arrives and it’s sent to the consulate, which is when we get our interview letters (Packet 3 and 4) that we schedule ourselves. 
 

this is why there is a small group of K1 applicants who are currently sitting at the Montreal consulate waiting for their interview. These are the people whose cases luckily reached the consulate before the last shipment date of March 20th but weren’t able to schedule an interview. This group is before K1 applicants at NVC.

Oh, wow! Let's just hope they aren't planning on addressing those 150 people first before moving on to new spousals/K1s. Hoping they do this simultaneously. Honestly, there's just always something or the other LOL.

 

EDIT: Oops, read the 150 number incorrectly. Hopefully, there's less people actually at the Consulate waiting for an interview that filed the lawsuit vs. those that just wanted the process to get started.

Not all 150 people are from Canada! They’re from all embassies all over the world. I think there’s only 2 from Canada in that lawsuit.

The preliminary hearing for the lawsuit isn't until October 22nd. No way they're acting on something that isn't decided yet and if they are they're just opening themselves up to more lawsuits imo (preferential treatment when rules for expedites are already predetermined, suing got them an earlier interview so why don't I also sue, etc).

Agreed, but didn't they already show preferential treatment by providing that one K1 filer (part of the lawsuit) an interview date?

Maybe he/she wasn’t part of the lawsuit though.. maybe an expedite?

We don't know for sure that that's the reason. It certainly looks like it but there could be so many reasons. Even when they started rescheduling the cancelled spousal interviews they didn't start at the top of the list. If there are more K1s that get interviews and are part of the lawsuit then we can get pissed but for now one coincidence doesn't equal data.
