I think this is what you were referring to - it was posted today. There's not much new here aside from "loosening" the restrictions around who can visit a Canadian, which will now include "extended family members of Canadian citizens and Canadian permanent residents, including those in an exclusive dating relationship of at least one year and their dependent children, as well as adult children, grandchildren, siblings and grandparents can come to Canada." The same 14-day mandatory quarantine rules apply though.

 

Curious to know whether the US land borders will similarly follow suit sometime soon to allow spouses to visit.

If your wife has a new job, and the joint sponsor is laid off, you should complete a new I-864 to take to interview. I would eliminate the joint sponsor completely as they no longer have current employment.

Near the end of October, you’ll see September stats released. We only just got August stats in the last 7 days or so.

My husband had is interview Monday, got his Visa Thursday. Crossed the border with his car yesterday with no issues at all. He had all his boxes labeled and they didn’t even want to look. He was able to bring his car across. We are waiting on letter from Volkswagen stating it is USA certified and he can take it with the form the CBP officer gave him to our airport and import it. He didn’t have to prove car was paid off. They didn’t even ask. All went well and the officers were really great and told him Welcome to the USA Sir. Hard to believe we have finished this process. For now. Citizenship in 3 years. Thank you all for your help answering questions and support along the way. So helpful to be able to talk to people that get it and understand all the forms and lingo.

I’ll be flying on Monday if I get my passport in the morning, if not on Wednesday. I really hope they tell me “welcome to the USA” 😁 It’d be a nice change of tone after grilling me so many times when I visited haha.

Do you think they’d put it in AP and cause delays afterwards? She’s still getting paid by her employer but I’m not sure for how long, hence why I’m curious to see how recent of a paystub they’d need.

It means that right now the DOS is not asking us for form DS-5540 and it is unavailable online. 

As of the middle of September we *could* be asked for that form, and we should monitor the DOS for their formal update statement regarding its requirement.

 

This is part of the public charge drama, where injunctions were filed against the requirement and overturned, and then another one was filed with respect to the state of emergency--and has now also been disregarded by the courts.

Who completes this form sponsor or the one coming into the USA? Might as well complete it.

To reiterate the comments from @Hawk Riders, there is an injunction against the implementation of the DS-5540 or the USCIS equivalent (I-944). The injunction is related to the difficulty in meeting the requirements during Covid. The case is making its way through the courts so we’re all hanging out with baited breath hoping that the injunction will hold. For now, we’re okay and the Public Charge documents are not required. If it becomes a requirement, the NVC should inform us prior the interview.

You are correct, thanks for clarifying. However, it may not apply to all applications (pending the date of the petition/application); see below.

 

"USCIS announced on September 22, 2020, that it would apply the new rule to all relevant applications or petitions postmarked or submitted electronically on or after February 24, 2020, including pending applications and petitions."

 

For now, this form is not required and as you said, DOS will provide an update. To be continued..

Right, partially.

USCIS won't go back on any already-approved I-130s, but the consular officers are/will be within policy guidelines to request this document and supporting evidence once DOS releases its formal update.
