Withdrawing an application to enter on a 6mo B1/B2 is a better choice for pending visa applicants than a denial of the application. @State and Maine, feel free to PM for further discussion.

The green card is in production provided you have paid the immigrant fee. If you requested your SSN be issued when you completed your DS260 all you need do is await its arrival, most likely. 

Mileage may vary. 

Our SSN was issued 2 days after POE yet we still await the GC; others have received GC within a week or 2 yet still await SSN...

I am not sure if they applie for B1/B2. They said they are Canadian citizen, and their application to enter the U.S. was withdrawn. If they have both B1/B2 visa and immigrant visa application pending, B1/B2 would most likely be denied. It would have no impact on immigrant visa unless a contradictory information was provided in the B1/B2 visa application (hiding the fact that they have U.S. spouse etc.). I dont know why a Canadian citizen would apply for B1/B2, but I agree if this is the case, they should withdraw it and just wait for immigrant visa to be approved.

Why are you stuck on this? Is it an non-immigrant visa/class of entry or not? If so, tonnes of people have been denied nonimmigrant visas or entry to U.S. on nonimmigrant visas while they have pending immigrant visa. It has no impact whatsoever on your immigrant visa.

Canadians do not have to apply for a tourist visa, but are still admitted to the US under B1/B2 status, which is the same status as those who formally applied for tourist visas. Because we do not formally apply, instead of a denial (which would happen at the consulate) we are offered the chance to withdraw our application to enter (at the border) so it does not count as a denial but as a withdrawal. It is important to disclose withdrawals (which have no negative effect on your application unless you received a ban at the same time) because hiding them absolutely can affect your immigrant visa application. 

 

They're "stuck on this" because you're giving out incorrect information.

Are you claiming a denied entry as a nonimmigrant has an impact on the immigrant visa? It does not, if the entry was denied for immigrant intent in the first place. An of course he/she has to fill out the immigrant visa application accordingly and disclose this incident. I never advised them to hide his fact. I am not sure why are you picking on my comment here.

They were supposed to give it to a supervisor to sort out. She called 3 weeks later and they said 3 weeks is too soon to receive SSN so I guess it's about time to call again. It'd be great if there was just one stage of this process that was streamlined and predictable.

We got married while I was on a B2 visa and made the mistake of not filing for adjustment of status right away (a very costly mistake). Instead, I flew back to Toronto and when I tried to come back to Miami, they took me into secondary and put DENIED in my passport and gave me a form with a checklist for next time that shows I have ties to Toronto. I should mention that at that point, we had not yet filed for spousal visa. So, I gathered the documents they asked me for and re entered again on a B2 for another 6m and when that was up and I left the USA, we filed for spousal visa right away. After that stressful event we hired a lawyer who has been guiding us through the process and he basically told me not to try to enter the USA until the process is finished and I get my green card. That being said, it has been 2 years since I have visited my wife in the USA and 1 year since weve seen each other. So to everyone on here, please please do your research and even speak to an attorney  before just to be sure as misinformation can cost you so much lost time and $ and potentially affect your futures.
I also see people posting here all the time how they go back and forth from Canada to the USA during the pandemic and in general while waiting for their interview etc and having no issues at the border and it does hurt and makes me a bit frustrated because our lawyer specifically advised us against it and we have been doing everything by the book and waiting and waiting which has been emotionally draining. I am now at the stage of waiting for my interview in Montreal , which who knows when will happen given the backlogs I had been reading about and we just got DQed beginning of September.

Hi everyone! After observing this forum for months I finally decided to join. Again, congratulations to everyone who finally got to reunite with their loved ones.  I will update my timeline shortly. I was just wondering if there is anyone on here who got DQ back in September and based on the stats can speculate when approximately I can expect my interview to take place.

I'm sorry to hear about your lessons. I would be shocked if anyone who goes through this process doesn't learn something or regret certain choices they made. 

 

As far as hiring an attorney it is very expensive and some people on this forum have been recieving very bad advice. 

 

I have done the entire process so far by doing my own research and being a member on these forums and, so far so good. If someone does want an attorney make sure you do your research and find a reputable one.

 

As far as your lawyer telling you not to visit that is not a rule period. There are many things you can do to prepare for a visit so you won't be denied at the border. My last visit was in March before the pandemic but I had zero issues going across the border, not only that, I was completely confident that I would be able to. To me this is your lawyer just wanting to be lazy and not tell you how you can properly visit your spouse or, even worse, they don't even understand the rules regarding visits.

We called and they said we have to wait 15 days then call social security office and make an appointment to see them in person to get social security number. We also called the USCIS office and when we did it activated them to send us the acknowledgment paper that he will get his green card and that the system acknowledges that they need to make it. Those things didn't happen until the date that we called the USCIS office. I expect more trouble down the line but as of now this is where we're at. my husband can't open a bank account, get his driver's license or a job until he gets a social security number.
