After more research, I now believe Trump and Senate leaders will move to get the vacant SCOTUS seat filled fast (I should have known this)....... I don't think Trump's nomination will be someone who is in favor of the use of foreign and international law materials to interpret US law, including the Constitution.

    I don't think there was ever a doubt that they would do that.

     There are very few legitimate reasons not to fill an opening as soon as it is prudent to do so. I don't see any reason not to nominate a replacement now. If they hadn't turned the whole process into a partisan circus, nobody would have an issue with it.

 

     I would not agree with an appointment between November and January if the president loses the election. Legally he still can, but I think it would be wrong to do at that point. No issue with appointing someone now though.

Navigating the party nonsense, we know why it wasn't filled in 2016.. the Republicans had the Senate, and Democrats had the Presidency, with Obama entering a lame duck session, which meant that Republicans could fill the seats. The last time that such a lame duck nomination was confirmed with opposing parties between the President and Senate, I'm told, was somewhere in the 1800s. Surely plenty of openings have occurred during that time before, which means that they were simply not put forth until the election. Of course, depending on how much one wants to pedant.. McConnell's initial speech spoke of a lame duck session where the President is serving his last term, not his first.

 

Nonetheless, I find it fitting idiots like Lindsey Graham very eloquently stuck his foot in his own mouth:

This guy is a classic relativistic say-anything-at-the-right-time politician. I mentioned the possible consequential nature of this sudden opening, and fittingly, Graham is looking at re-election and I'm sure every single Democrat related PAC and candidate anywhere around South Carolina is running that video all over the place.

 

Nonetheless, what the Republicans have faced with their prior nominations, especially Kavanaugh and the trashy "believe women" SJWs trying to kill his nomination by inventing accusations, the higher incidence of fraud already seen from the primaries, not to mention 2018, with the antics they're trying to pull with ballot harvesting, declarations of burning down SCOTUS+Congress, etc., the Republicans would be stupid not to confirm a justice asap. They know Biden cannot win, and they know it because they're the ones that set up the primary and everything for him to win, not to mention have their buddies regularly cover for him and continue the same tired strategy of invented scandals perpetuating in the "news" cycle.

The only calls that matter are those up for re-election. Lindsey knows if he puts off this nomination he could not only lose his GOP voters, he could be primary'd next election, he could be frauded out this election, his career is toast in numerous ways. So he has no choice but to back a quick nomination and confirmation.

 

Romney we know, along with Murkowski, will not be okay with a vote before inauguration day. That's 51 votes max. Susan Collins tends to be spineless, and Mitch will have to convince her that abandoning her party will be her death knell far worse than a Democrat beating her. Still, even though I don't think I've ever seen the VP break a tie on the Senate floor for a SCOTUS nominee, it's very much legal constitutionally and in the Senate rules. So he could even lose Collins with Pence casting the decisive vote, but he can't lose more than 3. Some have targeted Ernst and Tillis because they're up for re-election, in swing states, and on the committee.. I don't see them caving at all knowing what happened with Kavanaugh, most actually fighting through the entire charade.

 

Kamala is also on the Senate Judiciary committee, so she's gonna have to be there and not campaigning.. but it's not like Biden and Kamala are actually doing much anyways.

I think Trump will nominate a conservative female judge within a week or so.......as a result, I think the looney rioters will riot........and it will help Trump......In the end, the nominee will be confirmed...this is a nightmare for the far left......just my opinion.

It's only a nightmare if they're rebuffed in November. Unfortunately states like MI just allowed BH, voting past the election. You see plenty of reasons why the courts will be involved, so it's extremely meaningful for Trump to get his pick in as soon as possible, and if past the election, then not much past it.

   Scalia died in February. Obama was president for 10 more months. That is not what a "lame duck session" refers to.

 

  There was no valid reason to leave Scalia's seat on the SC open for that long. It was partisan politics where there shouldn't be any. The Republicans just did what they could to avoid another liberal justice being appointed and they were fortunate it worked out in the end.

I also looked back on Amy Coney Barrett's confirmation hearings where Democrats chided her for being religious, applying an unconstitutional litmus test to her nomination, then making her and others prejudge any abortion case that comes before them in the appellate court, even though they had already made up their mind they were going to vote against her to begin with. Even though she made it through the confirmation process, she got the psychological beating she'll remember when making future decisions. 

 

Unsurprisingly a statement made on behalf of RBG by a family member says her dying wish was that she wanted the President and Senate to wait until a "new president was installed".. if true, she blatantly politicized the courts here and acted as if the seat belonged to her and was for her to decide who supersedes her, when in fact it's the President's obligation to quickly nominate a replacement and the Senate exercise its advice and consent. 

 

Could argue the coulda shoulda woulda all day long, the fact is, it was never non partisan.
