Domestic travel in US during AOS?

Has anyone had any issues traveling DOMESTIC within the US after entry with a k1? 
 

we got married and adjusted status, case is in processing but wondering if we’ll have issues traveling through airport security if they notice that the k1 is technically expired. The proof of legal status we have is the acknowledgement from USCIS for pending AOS.

 

 Just wondering if anyone has had any issues/confusion with authorities because of this.
 

on another note, my wife is Venezuelan and her ID is literally a PDF print out that the Venezuelan government emailed her. Apparently they don’t have materials to print the ID cards and they tell citizens to print / laminate. It’s very low quality and almost looks fake. I probably wouldn’t believe it’s real if I didn’t know that’s how she received it... would this be a valid travel document though the airport even though it has no security features they are now requiring from many states?

 

we have her passport but given the difficulty of obtaining a new Venezuelan passport would rather not travel with it unless absolutely necessary. It’s also expiring 2022 so hopefully we have her green card by then. If not, can we use an expired passport to travel?

I don't see why there would be restrictions flying domestically, these are the items you can use: https://www.tsa.gov/travel/security-screening/identification You probably should use her Venezuelan passport to travel if you need

I don’t believe there are restrictions. Our lawyer also confirmed and recommended that we carry the papers from USCIS to prove legal status. Just wondering if anyone has run into issues or confusion (on agents end). I have friends who visited Puerto Rico on an h1b and their cruise ship got raided by immigration. They were fine but went through a lot of hassle (agents called his job HR to verify employment) and were told they needed to carry their passports even for domestic travel even though they have a valid Florida DL.

The moment she entered the US, her K-1 expired.  However, once she filed the I-485, she was granted authorized stay in the US until the I-485 has been adjudicated. She has no legal status, but she is authorized to stay in the US pending the outcome of the Adjustment of Status.  Just carry the I-797 she received after submitting the Adjustment of Status package along with her passport.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Going on a cruise even within the US was not smart without proper ID. Flying to Alaska is not smart. Both you can be emergently rerouted to another country. I wouldn’t travel with her paper ID. She should use her passport as a valid form of ID. I don’t see how she would not get her AP by 2022 unless you guys butchered the petition.

I travelled on domestic flights within US 2 times after my visa k1 expired and I hadn't any issue. I would recommend that you hold ur notice of action of adjustment of status and copy of your marriage certificate. No one asked me for these documents but have them with you just in case.

Since I came to the US last May on K-1 , my husband and I have been flying domestic every 2 weeks and I’ve never had a problem whatsoever. I flew before I got married, after I got married, before AOS, pending AOS and now after approved 2 year green card. The only difference is that I had to use the passport for the first few months. Then I transitioned to driver license and green card once it has been approved. No one asks you about your status if it’s a domestic flight. You don’t have to carry no documents with you. 👍🏻  She’s fine using her passport as long as it’s not expired . Also, why not getting her an ID/DL here?

Great! I know it shouldn’t be an issue I just wondered if anyone experienced any issues or extra checks. I wouldn’t imagine TSA is checking immigration status but who knows.

 

In FL you have to prove residency and/or have a SSN to get a state ID/DL. Once her EAD is approved well apply for that.

Okay I see. Too late to say but, maybe someone else will read it and take an advice. Get an SSN two weeks after you enter US. You can change the last name after marriage and AOS. Second thing, my husband put me on the water and electricity bills right after marriage, and that’s how I got a DL. It’s really not that hard if you do things right away because after 90 days you’re stuck in that “grey area” and can’t get much done at all. Best luck to y’all!
