So I have been waiting for my biometrics appointment for several months after receiving all my mail no problem, then all of sudden nothing so due to the pandemic/offices closing/delays i give it a little longer to the point everything is now open and getting concerned.

 

Called for three days to uscis to find out an update and the update is i have been denied (I-485) saying I did not turn up to my biometrics.

 

Im obviously confused and interrogate them as to why... cut a long story short they without any instruction/authorisation from me or any of the required paperwork changed my address and sent all of my documents out to an unknown address as they will not tell me what it was changed to but confirmed they changed it but had no paperwork to support this.

 

I have never changed my address and my attorney just double checked everything is all correct (OBV IT IS) so I filed a complaint as I want to know why it was changed. There response is they will look at it but at this time the case is denied nothing they can do.

 

Any advise or input on this they are supposed to get back to me within a week.

I have appointment to see my attorney Monday and is going to contact the senator and take the case to them, my convo to uscis was recorded, and they fully admitted that there is no reason my address should have been changed and is most likely a admin error as there is no AR11 in file with! with the amount of money I have spent plus time and care all of my packet has had.... is no acceptable reason my address should have just been changed. Someone somewhere was not doing there job properly and not gone through the proper checks to make sure this kind of error does not happen!

 

My family and I purposely settled down in a permanent address before starting this application to avoid any kind of address change and risk loosing mail then this happens!

 

They can never understand the stress this puts on my family that depend on my citizenship so I can help provide and take care of them at the minute my wife provides for myself and our 2 year old girl!

 

I have my fingers crossed they review the situation and come back to me with a solution for their error, not only has this caused major delay, the stress of several documents and my personal details being mailed out to some random person in the us!

Try to reach to your elected representative then, or the ombudsman. Are you certain your attorney isn't the one who made the mistake?

So to change my address I would have had to fill out an ar11 form (application for change of address) sign it and my attorney or I send it in. Obviously this never happened. To prove this on a recorded line (yes I did tell the uscis I was recording the call and for them to agree to it.) They admitted my address had been changed there is no record of a AR11 on file and they do not know why its been changed.

 

So to answer your question im certian there was no mistake made on my or my attorneys end, I check everything that is sent in and there is only one address on all the paperwork the correct current address.

 

All paperwork sent in is also duplicated and saved we have an exact replica of my packet that was sent in. I have been through it again and there is no reason for this mistake to have happened midway through my application. Infact ever.

Purely time as said i can not work for obvious reasons. Every week I cant work it costs more than a $1300 application that is going up to $1800 next week.

 

Basically I've been advised it could take months meaning thousands of dollars lost due to not being able to work vs a $1300 application and should be quicker as they should take priority due to them messing up. It does not mean I can not challenge them about the issue still I just don't see a quicker cheaper way of dealing with this.

I would be raising hell with my representative, I don't understand why you think that going back to square one will be faster. But, your lawyer might know better. 

 

If you fight now, you'll have some priority. If you file again, your another application among thousands.... No?

Thats exactly how I feel about it i have raised hell and waiting a response from uscis they gave a deadline of response by email on 24th september
