Changing Interview Location - Reapproved Case

Dear All

 

What is the process to request a file (I-130 worker perm residence) which was reapproved by USCIS and sent to the original consular post abroad.

My friend wishes to get it transferred to another post (country), as he will not be at the original consular location. NVC said they would not be involved with this process,

as they had handled the file initially, they also suggested that normally you ask consular office of the original location to transfer the file, once they receive the package from NVS.

.... or will they not permit this request under any circumstance, because they had reviewed the case initially?

Has your friend reached out to the original consulate? Do they have legal residence in another country? No rush really cause there is a ban until at least the end of the year

Yes they are a citizen of both places.........I'm aware of the green card band through Dec 2020, however if the file was approved 2 years ago I wonder 

if this is excluded ...if this applies to new applicants or 1rst time submissions....unclear.

No exclusions per se other than those listed in the proclimation(s).   Visas will be able to be issued after December 31st or until it is cancelled or extended.

What a head ache.....  so embassies still call you in and give you the approval, without mailing back the passport with visa? or only the Dec date will any of this take place........geeezzz

You need to contact the consulate that you wish to interview at and ask them if they will take it.   Then it gets requested from the other post.  The transfer can probably be done prior to the Presidential Proclamation expiration.  But a visa won't be issued until after.
