Hi all,

 

Apologies if this has been asked before, I have tried looking through the forums. Allow me to explain my situation/question

 

- On Aug 12th, after logging into the NVC website, there was a message in the inbox stating that my spouse does not meet the minimum income requirement to sponsor me and this will be determined in the interview, and went on to state that joint sponsorship is an option, which is a route we do NOT want to take.

- On Sep 2nd, after logging in, there was a notification stating that all my documents had been accepted and a follow up email said that an interview with the US embassy in Tokyo will be arranged. 

 

Now here is my concern and question.

Does the 2nd Sep notification nullify the Aug 12th notification (shes asking this not me)?

She filed her taxes earlier this year having lived and worked in Japan since 2014 - 2019 (yes she shouldve done it ages ago and not when she got back to the USA) and also filed her taxes for the time she'd spent working in the US. Now her earnings have been and are high enough, and she states that its higher than the minimum amount required. I believe that as she filed them earlier this year, there is a chance that they have not been processed on the US tax end. I am no accountant by any means.

 

Please advise on this situation, the last thing I want is to be denied a visa at the interview (Date TBC) because of all of this. Any help will be greatly appreciated.

NVC only does an initial document review to prepare it for the consulate. The first notice was likely notifying you that the CO makes the final call on the public charge issue.

 

What evidence of current income was provided?

Notification 1 is still valid.  That wording is given any time the last tax return doesn't show sufficient income to qualify, no matter what the current income is NOW, and no matter how much in, and what kind of assets are stated and documented.  The CO will make a judgment call based on the totality of circumstances.  If you want a prediction, then more fully disclose those details.

Facts are cheap...knowing how to use them is precious...

Appreciate your reply.

 

For current job, shes in the public school system in the US so she provided all her payslips. Same for the filing from her time in Japan, payslips from her job and I believe what taxes she paid here (income and residence). We are wondering if the filing hasn't processed yet and that's why we got this message? As mentioned, her income is over what is recommended to support a spouse... Thank you again,

Would you suggest I take ALL her payslips since she started working which will show how much she has earned/earns in a full calendar year to cover myself? Any advice would be greatly appreciated as we've come this far and we're a bit nervous that this final hurdle could ruin everything. I told her to check with who she filed her taxes with to find out the states to see if they have cleared on the IRS end.

Each pay stub shows year to date income.  Take the most current pay stub to the interview to show that she is still working at her current rate of pay.  Yes, less than a full year of work showing on her 2019 tax return is surely why you got that notice.  If the current income is clearly sufficient and comfortably over the minimum, you should be OK unless coming from India.  Please complete your profile so people can give you answers in country specific context.
