hi

I am principal applicant of f3 family married son and daughter visa my priority date is current now and my father has died.😭

Is it possible to continue my fee AoS and civil documents ?

Sorry for your loss.

 

There is the possibility for humanitarian reinstatement w/ a substitute sponsor and satisfactory reason/hardship. See https://www.nolo.com/legal-encyclopedia/what-if-i-die-before-the-immigrant-im-sponsoring-gets-green-card.html.

There is also INA 204(I) relief if you reside in the US. https://www.uscis.gov/green-card/green-card-eligibility/basic-eligibility-for-section-204l-relief-for-surviving-relatives

Sorry for your loss but your petition is no more. Do you have other parent or siblings in the US? Then we can try the humanitarian reason.

No sibling butt my nephew he is LPR green card holder

My father was 80 years old and I have joint sponsor can my sponsor fill my Aos now ?

These visas are for family reunification and with a deceased petitioner there is no family to reunite.

I am in the same boat I am reaching out in hopes of obtaining guidance or information regarding a humanitarian reinstatement or reaffirmation of an immigration petition due to the death of my petitioner. My case is currently at the NVC, and the embassy involved is in Islamabad, Pakistan. I am residing in the USA and am in urgent need of advice or information on how to proceed, as well as recommendations for any lawyers who specialize in this area. Any assistance or insight you could provide based on your experience with a similar situation would be immensely appreciated.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
