Hi,
 
We are ready to send out our AOS application for my K1. We want to make sure that we have everything. This is what we have in our folder so far (in that particular order):
 
 

- Check to USCIS

 
- Cover letter
 
- Copy of:
       1) USC passport page
       2) Copy of immigrant passport page
       3) Copy of marriage certificate
       4) 2 passport photos (immigrant)
 
- I-130 form: Petition for Alien Relative (since we are filing after the K1 visa expired)
 
- I-485 form: Adjustment of Status
 
- I-864 form: Affidavit of Support, in addition to copies of:
                    1) Letter of employment
                    2) Bank Statement
                    3) Most recent pay stubs
                    4) W2's from last 3 years
 
- I-765 form: Employment Authorization
 
- I-131 form: Advanced Parole
 
(No I-944 form since I was informed that it has been discontinued)
 
Is there anything that we are missing?

Not needed unless you MARRIED after the 90 days.   The K1 visa expired the moment you went thru the port of entry.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Second that. As long as you got married during the 90 days you're good.

 

What about tax transcripts or returns? You need at least the most recent one.

Everything looks great. Except for the i130..

Remember to include your most recent Tax Transcript..received an RFE and haven't heard from them since they received the rfe. GoodLuck

What about it?  During your overseas medical,  if you fulfilled the vaccination requirements at that time, an i693 is not required

They already have the ds3025 as it is a part of the medical.   However, you can include if you desire.

We actually did get married after the 90 days. So I'm aware I need to include the I-130. Is there anything I need to submit with that form that's in relation to it (separate fee to USCIS, copies of birth certificates, etc)?

The I-130A and all of the documents need for the I-130.   You will pay the fee for the I-130 as well.

 

You are now doing an adjustment from "other visa" and concurrently filing.   The K1 is meaningless.

Does this mean my case will get adjudicated differently, or will the time it takes for the AOS interview be any different, than that of a regular K1?

You have taken the worst parts of a fiance visa and combined it with the worst part of a spousal visa.

 

You get  AP/EAD in the same fashion as a K1

Your I-130 / I-130A has to be approved prior to getting the Green Card.  That is over a year.

 

You get to pay the fees for the AOS

You get to pay the filing fee for the I-130

Would this be ok for my cover letter:

 

"Dear Sir or Madam,

Enclosed please find the following forms and documents for Adjustment of Status. We included the I-130 “Petition for Alien Relative” because we got married after the 90-day period of our K1 Fiancé Visa. Contents include:

 

1.       Check for the filing fees for $1,225 made out to US Department of Homeland Security
 

 

2.       Money order for the filing fees for $535 made out to US Department of Homeland Security

 

 

3.       G-1145 c-Notification of Application/Petition Acceptance

 

 

4.       Form I-485- Adjustment of Status

 

 

5.       Form I-864- Affidavit of Support

 

 

6.       Form I-130- Petition for Alien Relative Form

 

 

7.       Form I-765- Employment Authorization

 

 

8.       Form I-131- Travel Document
