I'm now a US Citizen and would like to file a petition for my adult son who is married with 3 children.

I have a house and currently receiving a widow's benefit as only income.Since it is low ,does it

affect my petition? Thanks for any inputs.

Income is not considered when you file the I-130.

 

When his Priority Date is about to become current (10 years if he is single or 20 years if he is married), then you will need to file the I-864.  Your primary residence can not be counted as an asset.  You may need to find a Joint Sponsor who can meet the financial requirements of the I-864,

First, note that for Philippines (if the flag in your profile is correct) this category (F3] is likely to take 18-20 years before they can get visas.  This leads to a possibility that some of the children may age out if they will turn 21 during the process.

 

Second, you may file the petition, but at the time they will appear for their visas you will need to show adequate income as a sponsor for the case to be successful. Assuming no-one else in your current household and assuming all 5 people in his family will immigrate, at current rates you would need to show a minimum income of $43950 to sponsor them. Obviously this will increase over time. If you are not making sufficient income at the time they have visas available, you can find a joint sponsor.
