Timeline

We were approved for a K1 visa and married per the K1 requirements. Before we could adjust status he had to return for a family crisis. Yes this was a difficult decision and I hope others never have to make this choice but it could not be helped.

Now we are faced with filing as a K3 to be re-united. I have read the guides and I'm concerned about proving a bonafide marriage. He was here so short that we were unable to establish bank accounts or other assets. No one attended our civil ceremony and we were ok with this because we had planned a large celebration for the fall. He was able to get a social security card and a state ID but nothing else. Is there somewhere I can find a longer detailed listing of things to include to support a bonafied marriage?

No this is not a case of marrige fraud just an example of how life can take an odd turn just when you have it figured out.

No this is not a case of marrige fraud just an example of how life can take an odd turn just when you have it figured out.

I think you need to talk to an attorney and not rely on message boards for advice. In this situation you could end up really messed up at the embassy explaining what went wrong and why you are doing this a different way. You need to have very clear documentation of why exactly everything went down. I think you need to pay a consultation fee of an immigration attorney and devise a game plan. If you really love him , you do not need things messed up

I would contact and immigration lawyer. I believe since he has started the process and if you have supporting documents it should not be a big problem. You should also contact the USCIS and see what they believe to be the best options.

You could send along the documents of approval of the K1. If they already approved you for that one, you would think they considered your relationship to be bona fide.

Did you both have to leave the country together? You can join plane tickets and have someone write a letter on why you had to leave...

Based on what you've reported here you should have no issues significantly different from other K3s with regard to the proof of a bona fide marriage.

No way of knowing whether or not there are any significant issues associated with going home for a family crisis after entering as a K1 - you don't provide any information about that. A simple explanation if asked about the circumstances may be all that is needed. Or not.

Thanks for the replies...The problem was my husband was here only 3 weeks. From the first week after his arrival the family started calling saying they were about to have the family home taken away but some con-artists. No amout of phone calls could resolve the situation. His life's work was being stolen, so he had no choice but to return. We were married before his return and were unable to apply for the AOS.

As Yodrak said, I would think that your documentation of a bona fide marriage should not be much different from that of other newly weds. Affidavits (3 of them) from friends and family that can attest to the relationship, perhaps one from a family member concerning the crisis that prompted his return. You were approved once, they obviously felt your relationship was bona fide. You even got married on the K1, you just didn't file for AOS. I don't think this should be that big of a problem.

Make sure to include documentation of your K1 approval also.

Are you sure that the purported issue was the real issue? (It seems to have come quite quickly, unless you left something out of the explanation.) Has the issue been resolved? Are you sure?

Rhetorical questions with regard to VJ, but be prepared in case such questions arise with USCIS or the consulate.
