Delayed EAD Card

Hello, my Employment Authorization card was approved on May 12, 2020. The EAD card was never produced or mailed to me. I was told to wait the full 120 days before filing a receipt for inquiry (Out of processing time/never received document). The 120 days have elapsed, I’ve filed several receipts asking for my EAD card to be produced and mailed. My receipts all say “not assigned for processing”. 
 

Everytime I call USCIS they just give me a new receipt number. Does anyone have any other advice?

Have you had biometrics?

It happened to a couple people that they got approved but due to missing biometrics haven't received their cards yet. So that might be a reason in case you haven't had your bio appointment.

I recently was made aware that a class action law suit was filed against USCIS due to a delay in production of EAD Cards. Please see the link below for more information:

 

https://www.uscis.gov/i-9-central/form-i-9-verification-during-ead-production-delays-due-to-covid-19

 

As a result, people who have a "Form I-797, Notice of Action, with a Notice date on or after December 1, 2019 through and including August 20, 2020 informing an applicant of approval of an Application for Employment Authorization (Form I-765)" can use the Notice of Action (without an EAD Card) as a valid document for employment.  

 

I hope this is as useful to some people as it has been for me!

Yea but then you have to take a look what documents are needed for the I-9 and you'll notice that it's pretty much worthless for most of the people cause they can't get a class B document unless DMVs also accept the I-797.
