Should I file I751 jointly with my husband or I751 waiver by myself if we're gonna file our divorce 2months(maybe this July) prior to the day when I751 will need to be filed (this Sep)?

The fact is that we want divorce but the day for applying I751 is due in 2 1/2 months. What's the best way for our situation?

Will your hubby support you in filing?? Go to interview with you? Your divorce may not be final!

Yes, he will. and will go to the interview with me. Still friends.

So, any idea? should we divorce and file I751 jointly first (at this moment, for sure our divorce is still pending ),wait until our divorce finalized and reapply with the waiver by myself??? I believe some lawyer say that we shouldnot file I751 when our divorce is not finalized, so, in this case,should we file our divorce after filing i751 jointly? what's gonna happen if the day for interview is before our divorce is terminated? what's gonna happen if we have our divorced finalized before the interview?

I have a similar situation, except I have already recieved my conditional status and I am waiting to have it removed...my husband filed divorce and I my removal status is still pending. What should I do and am I ok? I sent everything they asked for prior to the divorce. I have a s.s. card and my conditional status was extended and additional year due to slow processing. Any help would be greatly appreciated!
