Timeline

Tell me if I am posting in the wrong topic!! I am currently on an L1A- married an American and submitted my adjustment of status back in September.... here is the timeline...

 

My question is- what can I do to speed up the EAD process? I am getting VERY nervous and VERY anxious to leave my current place of employment (that sponsors my visa). 

 

I130  Petition for Alien Relative
9/17/2020 We received your Form I-130, Petition for Alien Relative.
4/6/2021 We sent a request for initial evidence for your Form I-130, Petition for Alien Relative.
4/15/2021 Response To USCIS' Request For Evidence Was Received
   
I765 Application for Employment Authorization

You’ve been waiting 9 months for the EAD? Do you have your interview date? You’ll likely get your green card before or about the same time. That seems to be the trend in some I’ve seen

I was too impatient to wait for the notice to come and figured it was worth a shot, lol. I'd assume yours will be around the same time! I'm anxious!!! We do have a lawyer! Do you? 

What was your reason to expedite ?

Yep 9 months for the EAD....  I am gobsmacked I have waited this long.... I have seen EAD's come through much faster for people than mine, and I cannot understand why?  

 

No interview date as of yet either, just says its waiting to be scheduled.

Same. Ours doesn’t even say waiting to be scheduled yet. We just now finally got biometrics appointment.

I had my biometrics in March.... and then just radio silence. I tried to submit a query form and it wont let me because I am 'within processing times'. 

 

All I need is my EAD- i dont care about the GC. 

 

I also need to be able to travel overseas..... not even sure I can?!

@KateBurgr2021!! I probably would have created a thread to get more responses. To answer your question, if you have a job offer elsewhere, you can use that job offer to request to expedite your EAD/AP. Here is how to request to expedite https://www.uscis.gov/forms/filing-guidance/how-to-make-an-expedite-request

 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Oh gosh, really? You think a job offer allows me to expedite? I mean, I am willing to try!!!! Do I have to have a letter from my potential new employer outlining why they are impacted if I am not hired? Or just an offer as supporting docs?

@KateBurgr2021!! You did not submit a I131 (AP Travel document) as well? That is usually a common practice.

 

As far as your EAD is concerned, when is your L1A expiring? Can't your employer apply for an extension for that? Since you are already on a visa, USCIS might not consider your case to be worthy of an expedite request. USCIS accepts expedited request only for four reasons:

  1. Severe financial loss to family or person
  2. Urgent humanitarian reason
  3. Compelling U.S. government interests
  4. Clear USCIS error

 

You could still try to see if you can request an expedite under #1. Just chat with Emma, the automated system. In the live chat, just say "Expedite request" when the chat begins. Then have the following ready:

  1. Your A# if you have any
  2. A brief explanation of why you are requesting an expedite.

I am also on a work visa (H1B). My visa will expire soon, but I plan to ask my employer to apply for an extension while my marriage based AOS is pending, just in case. I plan to not use my EAD for work and just be on H1B until I get my green card. That is because if for some reason, my green card is denied (which I don't anticipate happening at all), then I still have status to work and stay in USA, while I pursue other options.

 

RoC Timeline:

  1. 12/04/2023 - Application sent to USCIS Elgin, IL lockbox
  2. 12/07/2023 - Application received by USCIS
  3. 12/12/2023 - Received "Your case received" text message from USCIS. Receiipt # starts with IOE
  4. 12/13/2023 - Check cashed by USCIS
  5. 12/19/2023 - Received in mail the I797 with the receipt number and the online access code
  6. 12/19/2023 - Received in mail the bio-metric re-use notification
  7. 12/21/2023 - Received in mail the I797 NoA extending my green card by 48 months

@KateBurgr2021!!, I think either one would work. Either way, I would suggest that you do a few searches on VJ to see how others proceeded. I know that often times people have to submit evidence to support their request to expedite. However, sometimes USCIS/the agent does not ask for anything and just proceeds with the request. 

 

You may want to fill out the I-131 which will allow you to re-enter the US in case you need to travel. I would fill it out and send it along with the supporting evidence. Let the agent know that you will send the I-131 along with it. (Don't know if this part will work or not).

2 weeks now of actively being reviewed makes me wonder about their definition of actively.

Update! 

 

So, 56 days later of my case stuck at 'Interview Has Been Completed and Case Must be Reviewed',  my greencard is being produced and has been approved!

 

Now I just have to wait for the mailed status, and I won't have to worry about the process for awhile.

 

Still hoping everyone else's case moves along faster too!

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.
