Becoming a student while waiting for wife's K1 AOS 485

Hi VJ community,

 

We are waiting for wife's K1-based AOS 485 interview, but in the meantime something big has changed: I got into my dream school.  Getting this degree will allow us to build a better life for our future family, so I have decided to enroll and become a full-time student for two years.   I am wondering where does this leave us with the income requirement for wife's K1 AOS 485 interview. 

 

When the K1 sponsor becomes a student, is there any breathing room for income requirements?  Can we show assets / savings in lieu of income during 485 interview?

Did she receive EAD / AP card? If yes, your I-864 form is sufficient, they hardly bring it up at interview, but a joint sponsor is recommended. Monetary assets are difficult to prove unless you have other house than your homestead residence.

Everyone has to meet the same financial requirements for the I-864.  A student would need to meet the same requirements as everyone else.  

You can use assets to meet the requirements.
