Just got an email from my lawyers assistant, saying to also include the following in my I-751 application.

 
  • Copies of passports (petitioner and beneficiary)
  • Two passport photos (I am in NY- not overseas)
  • Copy of I-94 Departure record
  • Copy of marriage certificate
  • Copy of social security cards (petitioner and beneficiary)
  • Letters from employers and paystubs (petitioner and beneficiary)
  • W2's (petitioner and beneficiary)
 
None of these things things are on the I-751 evidence list. Am I missing something (like an entire page of instructions?) or did she email me the wrong list? It looks like the list that I used for my I-485 interview. My application window opens TODAY and I'm now doubting all the hard work that I've been doing. Ahhh!

I would fire the lawyer, of course I never would have hired one in the first place. I-751 is about the most straightforward thing you'll ever do. Its basically just saying hey look we're still married. I don't understand what the pay stuff has to do with anything.

That seems over the top and even wrong. I would never send any copy of my SSN to anyone! That's a terrible idea. USCIS would never ask for that unless in some rare, specific case. I would only include the passports if you're planning to include stamps as proof of travel together. The employment stuff also needs totally unnecessary. Just include the taxes if filed together.

Thanks for your response!

USCIS actually requested both of our SSN during our interview two years ago.

TBH, I think she just mixed up the attachments that she sent me, but I wanted to get some feedback here while I waited for her email response.

Oh, OK! In that case, I get it. I would never send unsolicited copies though.

This seems more like a list for Adjustment of Status, not ROC.

I think your right, I-485 stuff. I just filed I751 10 days ago and included none of that stuff.

Seriously? If a government worker wanted to open up a fraudulent account they have your name and SSN they would have done it by now. Showing finances in a relationship is usually a part of the family inmigRation process

Didn't send one single of those when I send mine and we were fine.

Look like you're misunderstanding  what i said. OP said the request come from lawyer assistant and they want a copy of SSN card( this is totally wrong with me). Not talking about USCIS since they already have these information in database. The lawyer assistant can do many bad things with that, and in fact no one send a copy of SSN card with I-751 since it already included on the form.

Ignore it and file yourself, it's not difficult!   I didn't send any of that with my ROC package apart from the photos (I am overseas) and my passport, but that was my choice because I used it to verify my name change for my new green card.     ROC took 18 months but hey, no RFE!

I'm from the UK, hubby is from Michigan and is a retired US Army LTC.   We are currently stationed overseas.

Here is our immigration journey so far....

10.26.13 - Our wedding in Scotland 

11.26.14 - Filed I-130 at US Consulate, Frankfurt (DCF)

11.18.14 - Returned to Scotland to renew our vows for our first wedding anniversary

01.08.15 - NOA2 received in snail mail, together with case number and Packet 3 instructions

02.15.15 - Submitted Packet 3

02.17.15 - Packet 4 received by email with instructions to schedule medical and interview

02.18.15 - Email authorisation received from Consulate to gain access to appointment calendar

03.03.15 - Medical

03.18.15 - Interview - Approved

03.21.15 - Visa in hand

06.10.15 - POE Chicago (final destination Detroit)

07.20.15 - Received SSN in mail

07.27.15 - Received 2 year green card in mail

The journey to ROC starts here...!

10.05.15 - Returned to Germany on government orders

05.25.17 - Mailed ROC package to California Service Centre

06.14.17 - Received NOA 1 (dated 05.30.17) in mail

09.05.18 - Received a second NOA (dated 08.11.18) in mail granting a further six months extension to green card due to 'processing delays'

11.26.18 - ROC - Approved

12.05.18 - Approval Notice I-797 received in mail

12.18.18 - 10 year green card received in mail
