Divorce with American-born babies

I'm so sorrowful that I am even having to write this... I came to the US on a K1 visa and got married straight away, and gave birth to twins recently. The twins' father is the American I married.

My husband and I have had major daily conflicts ever since we got married, and he is an emotionally and physically abusive man. Mine and my babies lives have been made utterly miserable by him.

I am considering divorce, and I didn't come to that decision easily. I am now a green card holder. 

So can I take my babies to the country I came from so we can go and live there, far away from their father? Or would I have to stay here in the US?

That is not an immigration question, but rather one for family court.  Do you have a lawyer?

Like the above poster stated this is not an immigration issue and you need to have a lawyer involved if you do not already. Children make things extremely difficult.

Hi,

 

Sorry about your situation.

 

You will need either the father's written permission or a family court order allowing you to move your babies to your country.  Even though he's a shitty person, he has legal rights as the father.  You can not simply deprive him of his children because he's shitty.  

You need a good family lawyer who can file for divorce and help with child custody.

as the above, unless he agrees to it, then your children are likely going to have to stay in the US regardless.

Sorry to hear you are in such a terrible situation. I would contact a lawyer ASAP. Collect evidence of everything you mentioned and make sure you and your children are safe. There is  Domestic Violence Hotline you can call 1-800-799-7233 to get help. 

Do you have any friends or family in the US who could help? 

I wish you all the luck and hope you'll be able to resolve the situation!
