Hi Everyone, 

 

I'm new here and I'm helping my wife with an AOS after our recent wedding. The paperwork is more confusing than I expected, and I've found myself having a few questions already. 

 

I'll leave some background facts and timeline at the bottom, in case any of that info is needed.

 

Questions: 

 

1) On form I-130, do you list a state name with the city (ex. Part 2.6, 3.6)?

 

2) Do you leave some sections blank or explicitly write N/A for every question that does not apply? (ex. Part 2.1-2.3)

 

3) For addresses, it asks for a "From" and "To" date, is it OK to write "current" if we are currently living here?

 

4) On her electronic I94, most recent date of entry is incorrect. It shows her previous entry in 2018. If you view all entries, it does show the correct most recent date of entry. Is there any way to fix this? Could we just print out the page showing ALL entries and attach that to the documentation package? 

 

5) On I-130 part 4.46 "admit until" date - as mentioned, the most recent date of entry on electronic I94 is wrong. This is the only page that shows the "admit until" date. Any advice on how to resolve this?

 

6) Since a B2 extension was filed, the "admit until" date on a correct I94 would still show a date ~6 months ago. Is this a red flag or would this cause problems? Should I include anything extra to help prevent any issues with this part? 

 

7) For I-130 Part 4.61a-4.61b, I'm asked to include info on the USCIS office that we'll file at. I see a field office that is very close, but it's unclear whether she could file / apply at this office. How do I find the closest office available that she could apply for AOS with? (for purposes of the I-130 form)

Me, US citizen

Wife, Brazilian citizen visiting on a B2 visa

 

Timeline:

August 2019: Wife arrives in US on B2 visa

October 2019: We meet in a bar, start dating 

Jan 2020: Wife files visa extension to continue sightseeing in US with me (her boyfriend at the time) 

Feb 2020: Biotmetrics completed for visa extension

Late March 2020: Move in together (with Covid in full swing, we chose this over social distancing in different cities)

Aug 24th 2020: We get married  :)

Aug 25th 2020: Govt requests more info for visa extension (weird because even if granted, would only allow for Aug 25th departure date) 

Sept 2020: Come back from honeymoon, start AOS process

It was filed but never processed? Just include a copy of the application receipt proof and explanatory letter.

The original I94 admit until date was 2/25/20. The B2 extension application requested 6 months additional stay until 8/25/20.

The gov't responded with a letter dated 8/25/20 requesting more information to process the application. 

This is strange to me...it's technically still pending, but even if approved - wouldn't she be automatically overstaying as soon as the application is decided?

Thank you. I had used this tool before...Are these field offices able to handle the application filing? I wasn't sure if they offered only a subset of the services compared to a full office.

You'll still send your initial full application to the Chicago Lock Box. They just want to know where you will eventually be interviewing/interacting with.

I think I did both, depending on how obvious the location was from the city name. I don't think it should really matter.

The lawyer who looked over my forms said to put in N/A at the beginning of a section. (i.e. other names used, or kids, or other addresses) but you didn't need to fill it in for every box after that.

Yes. I think "PRESENT" was actually already filled in on my version of the forms.

 

If you haven't already, I strongly suggest looking at the Sample Immigration Forms. They helped me a lot with knowing how to approach the forms.
