Ugh the industry I work in usually only gives full-time offers. Going into this my only hope was that I will switch jobs. Now it is all doomed. I am so frustrated. I see no point in anything right now with all my efforts not even paying off... So bad. I wish I knew that they discriminate against EADs vs GCs.

My industry gives me that flexibility to find temporary jobs. But just keep applying. No long stories, just tell them your EAD will be renewed if your GC is not ready by the expiration date. Please be hopeful, we will all overcome this soon.

Speaking of the EAD card, I talked to a new employer today and they were asking so many questions on my EAD card and what happens with my petition etc.. Is it possible that they will deny my candidacy based on this uncertainty? Is it even legal? My current C09 EAD is valid until Sept. 2021. 

 

 

If your I-485 was not denied then your I-765 is still valid, and of course you need to check the expiration date.

I guess it's not a secret that life is very expensive even to the authorities, so given some circumstances they are willing to forgive unauthorized work and unlawful presence. It's much smaller offense than hiding it. Even without anyone else to support, bills are piling up and a meal last only so long.

 

It is vise to disclose every place that you've received paycheck or any traceable contract job, even under the table jobs (don't count that 20 bucks you've got moving someone's lawn, but you get the idea:).

 

Joke aside.

You can't afford any little discrepancy to discredit your application. Once caught in lie, you'll be deemed inadmissible. It's much harder matter to overcome. There is no white lie in USCIS. The stakes are too high and most of Vawa filers will get only one chance to file.

A friend of mine, lawyer, said to me: It's better to be truthful 100%, no matter what, and be ready to explain yourself, than to close this door pretty much for good. With proper timely honest affidavit you can overcome pretty much everything within reason.

All the documents are filed to the best of knowledge and ability at the time of signing. And they know it. An honest mistake or a typo can be corrected if addressed on time. It should not be a problem.

 

We all know or heard of someone, that 'forgot' to mention some crucial info in the application or added something to make it look better and streamline the process, but in the end all hidden may come forth at any time. Even a passport can be revoked if the 'forgotten' detail is dire enough. Unfortunately this will never go out of style, always someone will think they're better and try to cut in line. We need to be strong and resist the temptation. One little tick on 'Citizen' or 'Permanent resident' on an application can turn things 180 real quick years later. Can't have that!

 

To be honest I think next best thing after no unauthorized employment at all is to show some work history with big chunk of earnings going to taxes, just like anyone else.

 

As for HR dept talk, hope they will be satisfied if you tell them that you are waiting on GC which is taking some time and your EAD is to be renewed unlimited times until you get it. As a proof show NOA for your I-765 that states automatic extension for 180 days. On top, I hope they will be courteous to people waiting for their EAD or GC to arrive and be satisfied with E-Verify check or printed self-check. At least that's my wishful thinking. Can't take it away form me lol😁

I was in a similar situation. I was scared when I just got my first EAD and I was mentioning it to every employer and not many companies were ok with that. I recently switched jobs and I didn't even mention my GC situation during the interview. I only disclosed it to HR when they asked and when filing I-9 forms. There were no issues or questions about it. You have the right to work with a valid EAD and a pending GC should not be a problem for most employers

My Adjustment Of Status is pending and I am waiting in line for USCIS to approve my petition. I have the legal right to work til 2021, it is something I regularly get renewed and is regular procedure with USCIS. I will keep the HR notified of changes periodically and as needed. I do not need you to file a petition for me and do not anticipate it either.” 
 

that is what I said. 
you DONT need to explain what kind of case you have, it’s not their business. All they need to know is that you can work legally and that they don’t need to petition for you. 
 

just be nice, complain in a joking way how USCIS is so slow.. etc etc

This makes sense, next time I will say that. This was my first interview and although it was really hard to get, I hope I get another chance somewhere else.

just to ensure and apologies for asking: the tax returns were not submitted as part of I-485 and thought it’s not needed to submit them or take to the interview. I did submit joint tax return when was filing I130/485 wth ex abusive spouse). Did officer asked for them and reviewed them during your interview? How meticulous are they? My tax returns a bit messed up bc of divorce.
