What is I864 and what is abstract of marriage? I also thought good faith marriage proof Docs like pics and billsΒ is not needed for Vawa i485 interview?

Β

not to mean to double question here but @sandranj and @Stillwinning!!!😊 _ would the list above be exhaustive and what is needed for the interview?

Oh okay just.. take all the documents showing the prenup and Divorce with you also I took with me (originals). Officer took the divorce decree to update my file.

all passports

, birth certificate,

I-94, proof of Income and tax returns do I-864w ( just to be safe)

Medical examinationΒ

Driver licenseΒ

All EAD cards

divorce Decree

abstract of marriage, certificate of mariage

bills, pictures and bank statements.

As a reminder officer only asked me my spouse name. But nothing about my past marriage or abuse.

but interview was very tricky specially about yes or no question. Please review the I-485 that you sent read and remember what you said.

something I remember also is traffic ticket take with you any court related traffic ticket. The officer took it and asked me if there was anybody injured in the accident I was into, thanks God the response was no.

from that point I knew USCIS knows every little thing about us

Β

Wow thanks a lot for sharing.Β
Β

did you take all your past traffic tickets or officer pulled them somewhere? What type of questions from I485 were asked and I assume it’s only I485 that is attached to I360 And NOT to I130?

I864w is the waiver for affidavit of support, abstract of marriage is basically the original document which shows you and your spouse's names and date of marriage only. Not sure if you need that. The certificate will do. You also don't need the i864w also as it's not required. You basically want to go with your original documents..personally I went with my marriage certificate, birth certificate, drivers license, recent 3yr tax documents, employment verification letter, passport, i-94 document, EAD card. If you are divorced, be sure to go with the decree too.πŸ‘

The form is i765!Β If you submit the Form I-765 with an immediate family based green card application (Form I-485), then the fee is automatically waived. If you're filing the Form I-765 separately, the filing fee is $410. You must also pay an additional $85 biometric services fee, for a total of $495.πŸ‘

Hello Stillwinning/ Sandra,

Β

We have this confusion regarding EAD filing fees and would appreciate your input here!Β

Β

Current status- i360 pending

Marriage based i485 pending (requested to be held in abeyance). Did not apply for EAD during marriage i485 filing. i485 filing fees paid then.

Β

We have decided to file for EAD now underΒ c09 category (first time).

Β

Since c09 is for pending adjustment of status, stillwinning mentioned above that fees for i765 will be automatically waived. But sandraj mentioned in a post thatΒ if you are submitting the l765 for the first time after you submitted the l485, then pay the feeΒ or submit form l912 asking to waive the fee, you need to prove you don’t have money to pay them.

Β

So my confusion remains- do we automatically get fee waiver if we send in the i765/i131 package for pending i485 or do we need to prove that we have financial hardhship and request for fee waiver.Β

Β

When I look at the uscis fee calculator, it says no fees. So we should just send our i765/ i131 with pending i485 receipt, i94, photographs and fees should be automatically waived, correct?

Both statements are valid. If you're submitting the petitions (i485, i765 and i-131) together, the fees for EAD and AP will be automatically waived! But if you already filed for i485 and are submitting the i765 and i-131 as an afterthought, fees will apply..that's the explanation of both statements. Best comply to avoid unnecessary delays like others discovered much later.πŸ‘

Thank you so much - do we need to bring tax returns? Only asking as thought they are only required for naturalization InterviewΒ and if attending interview with a spouse.Β

Officer asked me if I ever had a ticket When I replied yes and told her it was dismissed, he then asked from court documents.

admissibility question from I-485 form. The yes or no

Good evening everybody.

Just a feedback about my initial interview.

Today I went to the interview along with my child without my EX, to my own understanding, I thought I wont spend more than 20 min, just to let them know that I already file vawa, though I already mailed my vawa recipt to them few weeks before I was scheduled for an interview .Β

To my greatest suprise I was interviewed,Β  I spent nothing less than an hour for theΒ intetview after the security checks at the door, I was called by the officer which I spent almost an hour in her office. She asked me theΒ  basic question from my form , then he ask about where I lives, my work, wedding date, my Ex children and she asked for evidence of our marriage which I handed over to her , as she was asking me thoseΒ questions she keeps on written things downΒ . After the whole process she told me she can'tΒ Β aprove my case untill am aprove for vawa. She collected all the Evidence and tag them with small papers. I decided to write this here may b someone might need it.Β Thanks

When the officer told you your case can't be approved until your vawa is approved, what did you say in your defense? And you mentioned you mailed your vawa approval notice to them ahead of time...who advised you to do that..I don't see the point..it's uscis..it's in their system..just wonderingπŸ’ regarding the interview, once in a while, we hear stories of officers like the one you got..who wanna re-adjudicate..I'm surprised you didn't speak up to say your vawa is approved and perhaps presented the original copy!😏 really don't know what else to say at this point...

So help me God!πŸ˜‚πŸ˜‚ ok so we're looking forward to good news sometime in the future then..πŸ™
